Meenal Jain - 09-01-2021
The Supreme Court found that the developer had illegally constructed two towers — T16 and T17 with 40 floors — without prior sanctioned building plans, and in violation of provisions of the various building regulations.
Key point of the judgement are :
- The sanction given by NOIDA on 26 November 2009 and 2 March 2012 for the construction of T-16 and T-17 is violative of the minimum distance 16 meter requirement under the NBR 2006, NBR 2010 and NBC 2005
- By constructing T-16 and T-17 without complying with the Noida Building Regulations 2006.
- Building plans were not disclosed despite notices.
- The UP Fire Prevention and Fire Safety Act, 2005 Fire safety norms were violated.
- A criminal action against Supertech and Noida officials under the UP Apartments Act and UPAID will be initiated.
