9 special powers: –

9 विशेष शक्तियां:-

9.1 Decisions taken by the State Government from time to time on the subject of these regulations The orders/notifications issued on this basis shall be deemed to be part of these regulations. Any ambiguity in the technical interpretation of any provision of these regulations or In case of typographical / clerical error, the Chief Town Planner, Rajasthan or in this regard the town planners authorized by the state government will be authorized to issue clarifications/corrections at their level.

9.1 इन विनियमों के विषय पर राज्य सरकार द्वारा समयसमय पर लिये गये निर्णयों के आधार पर जारी किये जाने वाले आदेश/अधिसूचना, इन विनियमों के भाग समझे जायेंगे। इन विनियमों के किसी प्रावधान की तकनीकी व्याख्या करने, भांति अस्पष्टता होने अथवा टंकण/ लिपिकीय त्रुटि की स्थिति में मुख्य नगर नियोजक, राजस्थान अथवा इस संबंध में राज्य सरकार द्वारा अधिकृत नगर नियोजक अपने स्तर से स्पष्टीकरण / शुद्धिकरण जारी करने हेतु अधिकृत होंगे।

9.2. Such buildings in respect of which norms are not prescribed in these regulations, or there is any discrepancy in the provisions of these building regulations or to propose amendments in these building regulations or in public interest in any of the provisions of these regulations
For giving relaxation, the decision can be taken by the state government according to the recommendation of the committee by presenting the case to the expert committee constituted by the state government. The composition of the Expert Committee will be as follows-

Incharge Secretary, Urban Development Department President

Chief Town Planner, Rajasthan – Member

Director, Local Government Department Member

President/Secretary Indian Institute of Architects Rajasthan Chapter representative nominated by – Special Invited member

Senior most city planner member secretary posted in Urban Development Department – secretary

Other subject experts, representatives of developers can be invited accordingly as required by the committee.

9.2. ऐसे भवन जिस बाबत इन विनियमों में मानदण्ड निर्धारित नहीं है, अथवा इन भवन विनियमों के प्रावधानों में कोई विसंगति है अथवा इन भवन विनियमों में संशोधन प्रस्तावित करने के लिए अथवा जनहित में इन विनियमों के किसी प्रावधानों में शिथिलता देने हेतु राज्य सरकार द्वारा गठित एक्सपर्ट कमेटी में प्रकरण प्रस्तुत कर कमेटी की अभिशंषा के अनुसार राज्य सरकार द्वारा निर्णय लिया जा सकेगा। एक्सपर्ट कमेटी का गठन निम्न प्रकार होगा-

प्रभारी सचिव, नगरीय विकास विभाग – अध्यक्ष

मुख्य नगर नियोजक, राजस्थान – सदस्य

निदेशक, स्थानीय निकाय विभाग -सदस्य

अध्यक्ष/सचिव इण्डियन इंस्टीट्यूट ऑफ आर्किटेक्ट्स (Indian Institute of Architects) राजस्थान चेप्टर

द्वारा मनोनीत प्रतिनिधि विशेष आमंत्रित सदस्य

नगरीय विकास विभाग में पदस्थापित वरिष्ठतम नगर नियोजक- सदस्य सचिव

समिति द्वारा अन्य विषय विशेषज्ञों, विकासकर्ताओं के प्रतिनिधियों को आवश्यकता अनुसार आमंत्रित किया जा सकेगा। सकेगा।

9.3. Under these regulations, in case of dispute between the developer and the concerned urban body in any case of building approval, such case regulation 9.2 will be presented before the expert committee for decision and the decision can be taken by the state government on the recommendation of this committee.

9.3. इन विनियमों के अन्तर्गत भवन निर्माण स्वीकृति के किसी प्रकरण में विकासकर्ता एवं संबंधित नगरीय निकाय के मध्य विवाद होने की स्थिति में ऐसे प्रकरण विनियम 9.2 के तहत गठित एक्सपर्ट कमेटी के समक्ष निर्णय हेतु प्रस्तुत किये जायेंगे तथा इस कमेटी की अभिशंषा पर राज्य सरकार द्वारा निर्णय लिया जा सकेगा।

9.4. Relaxation in any building norms payable under these regulations, such as setbacks, coverage, building height, B.A.R, parking etc. can be given by the state government after approval.

9.4. इन विनियमों के अन्तर्गत देय किसी भी भवन मानदण्ड में शिथिलता यथा सैटबेक्स, आच्छादन, भवन ऊँचाई, बी.ए.आर., पार्किंग आदि तथा विशेषपरिस्थिति में देय शुल्क में शिथिलता माननीय मन्त्री, नगरीय विकास आवासन एवं स्वायत्त शासन विभाग के अनुमोदन पश्चात राज्य सरकार द्वारा दी जा सकेगी।
