10.4. Provision for Buildings in Special Areas

10.4. विशेष क्षेत्रों में भवनों हेतु प्रावधानः

For specific areas such as important locations from a security perspective, restricted areas, protected sites of historical importance, significant tourist locations, lake conservation areas, designated forest areas, heritage sites and environmentally sensitive areas, the central government has established standards for the construction, planning, design, height, etc. of buildings separately. The criteria specified for these buildings in these areas will be above all other building regulations, and approval in such protected areas will only be granted according to the standards set by the central / state government.

The state government can determine such areas and their specific criteria based on proposals from local bodies. Approval for building construction in these designated areas will be given only in accordance with the specific standards approved by the state government.

विशिष्ट क्षेत्रों यथा सुरक्षा की दृष्टि से महत्त्वपूर्ण स्थानों व निषेध क्षेत्रों, पुरातात्विक महत्व के सरक्षित स्थलों, पर्यटन की दृष्टि से महत्वपूर्ण स्थलों, झील संरक्षित क्षेत्र अधिसूचित अभ्यारण्य क्षेत्रों, हैरिटेज स्थलों के आस-पास एवं पर्यावरण संवेदनशील क्षेत्रों आदि संरक्षित क्षेत्रों जिनके लिए केन्द्राराज्य सरकार द्वारा पृथक से भवन की संरचना, अभिकल्पन, डिजाईन, ऊँचाई आदि हेतु मानदण्ड निर्धारित किये गये है, ऐसे क्षेत्रों में उक्त मानदण्ड इन भवन विनियमों के प्रावधानों से सर्वोपरी होगें, तथा ऐसे संरक्षित क्षेत्रों में केन्द्र/ राज्य सरकार द्वारा निर्धारित मानदण्डों के अनुसार ही स्वीकृति दी जा सकेगी। स्थानीय निकाय के प्रस्ताव पर ऐसे क्षेत्रों का निर्धारण एवं उनके लिए विशिष्ट मापदण्डो का निर्धारण राज्य सरकार द्वारा किया जा सकेगा। इस प्रकार विर्निदिष्ट क्षेत्रों में भवन निर्माण स्वीकृति राज्य सरकार द्वारा स्वीकृत इन विशिष्ट मापदण्डों के अनुसार ही दी जा सकेगी।
