10.9. बी. ए. आर. (Builtup Area Ratio):-
10.9.1. For all the plots of various uses specified in Table 1, the proposed built-up area ratio is more then standard BAR shall be allowed subject to the following conditions:
10.9.1 तालिका 1 में विभिन्न उपयोगों हेतु सभी क्षेत्रफल के भूखण्डों हेतु निर्धारित मानक बी. ए. आर. से अधिक प्रस्तावित बी. ए. आर. सीमा तक निम्न शर्तो पर अनुज्ञेय किया जा सकेगा –
(a) If the applicant proposes to use TDR, 75% of the TDR shall be adjusted against the proposed built-up area ratio and the balance 25% of TDR amount shall be deposited with the local authority. Otherwise, the proposed built-up area ratio over and above the permissible built-up area ratio as per the standards shall be subject to complete Betterment levy as determined by the local authority in accordance with the procedure determined by the local authority and deposited in the local body’s fund.
(क) यदि आवेदक द्वारा टी. डी. आर का उपयोग करना प्रस्तावित हो तो 75 प्रतिशत टी. डी. आर. मै समायोजित होगा व शेष 25 प्रतिशत टी. डी. आर. की एवज में राशि स्थानीय निकाय में जमा की जावेगी। अन्यथा मानक बी. ए.आर से अतिरिक्त प्रस्तावित बी. ए. आर. पर देय नियमानुसार सम्पूर्ण बेटरमेन्ट लेवी स्थानीय निकाय द्वारा निर्धारित प्रक्रिया अनुसार, निकाय कोष में जमा करानी होगी।
(b) The proposed height of the building shall not exceed the permissible height.
(ख) भवन की प्रस्तावित ऊँचाई (Height) अनुज्ञेय ऊंचाई से अधिक ना हो।
(c) There shall be no limit on the maximum permissible built-up area ratio (FAR) for calculation purposes, i.e., whatever is the calculated built-up area ratio (FAR) proposed shall be permissible. The construction of the building shall be proposed within the permissible limit of the prescribed height.
(ग) अधिकतम अनुज्ञेय गणना योग्य निर्मित क्षेत्रफल (बी.ए.आर.) की कोई सीमा नहीं होगी अर्थात् निर्धारित ऊँचाई में जो भी गणना योग्य निर्मित क्षेत्रफल(बी.ए.आर.) प्रस्तावित होगा, वह अनुज्ञेय होगा। अधिकतम निर्धारित ऊँचाई की सीमा में भवन का निर्माण प्रस्तावित किया जा सकेगा।
(d) If the calculated built-up area ratio proposed exceeds the standard calculated area ratio specified in Table 1 , then the proposed built-up area ratio over and above the permissible built-up area ratio as per the standards shall be subject to Betterment levy as determined in accordance with the rates specified in Schedule-2 (-7).
(घ) तालिका-1 में दर्शित मानक गणना योग्य क्षेत्रफल से अधिक गणना योग्य निर्मित क्षेत्रफल प्रस्तावित किये जाने पर मानक बी. ए. आर. से अधिक प्रस्तावित बी. ए. आर. पर बेटरमेन्ट लेवी की दरे अनुसूची-2 के क्रम से -7 के अनुसार देय होगी।
