4.4 वाणिज्यिक भवन (Commercial Building) :-

3. वाणिज्यिक परिसर :-
किसी भी प्रकार वाणिज्यिक परिसर, कार्यालय परिसर, रेस्टोरेन्ट, बैंक आदि हेतु मापदण्ड योजना होने पर योजना के अन्यथा तालिका-01 के अनुसार रखे जाने अनिर्वाय होंगे।

3. Commercial Complex:

For any type of commercial complex, office complex, restaurant, bank, etc., if part of a planned scheme, the standards shall follow the scheme provisions; otherwise, compliance with Table-01 shall be mandatory.

4. गेस्ट हाउस (Guest House) / लोजिंग एवं बोर्डिंग हाउस (Lodging & Boarding House)

(i) गेस्ट हाउस/लोजिंग एवं बोडिंग हाउस, व्यावसायिक / गेस्ट हाउस प्रयोजनार्थ जारी लीजडीड पर अनुज्ञेय होगा।
(ii) भूखण्ड का न्यूनतम क्षेत्रफल 500 वर्ग मीटर होगा।
(iii) बड़े शहरों में 18 मीटर व मध्यम/लघु शहरों में 12 मीटर से कम प्रस्तावित सड़क पर अनुज्ञेय नहीं होंगे।
(iv) अन्य तकनीकी मानदण्ड यथा सैटबैक, बी.ए.आर.. भू-आच्छादन, ऊँचाई आदि तालिका-1 के अनुसार अनुज्ञेय होंगे।

4. Guest House / Lodging & Boarding House:

(i) Guest House / Lodging & Boarding House shall be permissible only on lease deeds issued for commercial / guest house purposes.
(ii) The minimum plot area shall be 500 sq. m.
(iii) In large cities, they shall not be permitted on proposed roads less than 18 m wide, and in medium/small towns, not on roads less than 12 m wide.
(iv) Other technical standards such as setbacks, FAR, ground coverage, height, etc., shall be permissible as per Table-01.

4.3 General Rules of Residential

4.4 वाणिज्यिक भवन (Commercial Building) :-

1. सामान्य नियम (General Rules) :-

(i) वाणिज्यिक भूखण्ड किसी स्वीकृत योजना का हिस्सा होने पर योजना के प्रावधान / पैरामीटर्स लागू होंगे व सड़क की चौड़ाई योजना अनुसार ही मान्य होगी अर्थात किसी योजना में 12 मीटर से कम चौडी सडक पर यदि दुकाने प्रस्तावित है तो उस पर निर्माण स्वीकृति दी जा सकती है। योजना में यदि किसी भूखण्ड पर भूतल पर शत प्रतिशत निर्माण अनुज्ञेय है तथा योजना में सार्वजनिक पार्किंग का प्रावधान रखा गया है तो वहाँ पृथक से पार्किंग का प्रावधान करना आवश्यक नहीं होगा एवं पार्किंग की पूर्ति हेतु कोई शुल्क भी देय नहीं होगा।

(i) Where a commercial plot forms part of an approved plan, the provisions/parameters of that plan shall apply, and the road width prescribed in the plan shall be considered valid. Accordingly, if shops are proposed on a road less than 12 meters wide as per the plan, building permission may be granted. If, in a plan, 100% construction on the ground floor is permissible on a particular plot and public parking has been provided for in the plan, then separate parking provision shall not be required, and no parking fee shall be payable to meet the parking requirement.


(ii) जिन व्यावसायिक योजनाओं में टाईप डिजाईन निर्धारित है, उनमें टाईप डिजाईन के आधार पर ही निर्माण स्वीकृति दी जावेगी। आंतरिक संरचना टाईप डिजाईन से भिन्न भी हो सकती है। यदि ऐसी पुरानी योजनाओं में वर्तमान परीपेक्ष्य में नवीन निर्माण किया जाना प्रस्तावित हो तो ऐसी योजनाओं का पुर्नविकास प्लान (Re-development Plan) तैयार किया जाकर ही तदानुसार नवीन भवन निर्माण स्वीकृतियां जारी की जानी होगी। एकल रूप में टाईप डिजाईन से भिन्न स्वीकृति नहीं दी जायेगी।

(ii) In commercial schemes where type designs have been specified, building permission shall be granted only on the basis of the approved type design. The internal layout may differ from the type design. If new construction is proposed in such older schemes in the present context, a Re-development Plan must first be prepared, and building permissions for new construction shall be granted accordingly. No individual approval deviating from the type design shall be granted.


(iii) वाणिज्यिक बहुमंजिला भवन 1000 वर्गमीटर से अधिक क्षेत्रफल के भूखण्ड एवं सड़क की चौड़ाई न्यूनतम 24 मीटर होने पर ही देय होंगे।

(iii) Commercial multi-storey buildings shall be permissible only on plots measuring more than 1,000 sq. m. in area and having a minimum road width of 24 meters.


(iv) 2500 वमी से अधिक क्षेत्रफल के वाणिज्यिक भूखण्डों पर तालिका-01 में अंकित आच्छादित क्षेत्र के स्थान पर अधिकतम आच्छादित क्षेत्र 50 प्रतिशत देय होगा।

(iv) For commercial plots of more than 2,500 sq. m. in area, in place of the covered area specified in Table-01, a maximum covered area of 50% shall be permissible.


(v) वाणिज्यिक भूखण्ड पर वाणिज्यिक / पर्यटन इकाई/आवासीय / संस्थागत उपयोग एकल उपयोग अथवा सम्मिलित उपयोग के भवन अनुज्ञेय होगें एवं समस्त शुल्क व मापदण्ड तदानुसार प्रस्तावित उपयोग के अनुसार ही लागू होगें।

(v) On a commercial plot, buildings for commercial/tourism units/residential/institutional use—whether for single use or mixed use—shall be permissible, and all applicable fees and parameters shall be applied according to the proposed use.

2. लघु व्यावसायिक प्रतिष्ठान / दुकानें (Convenient shops/ Establishment) :-


(i) लघु व्यावसायिक प्रतिष्ठान / दुकानें योजना का भाग होने पर भवन के मापदण्ड वाणिज्यिक भवनों के सामान्य नियम (i) एवं (ii) के अनुसार लागू होंगे अन्यथा तालिका-01 के अनुसार रखे जाने अनिर्वाय होंगे। यदि योजना में सार्वजनिक पार्किग का प्रावधान रखा गया हो तो 50 व.मी. क्षेत्रफल तक के भूखण्डों में पृथक से पार्किंग प्रावधान किया जाना आवश्यक नहीं होगा। 50 वर्गमीटर से बडे भूखण्डों में भूखण्ड के अन्दर तालिका-16 के अनुसार पार्किंग प्रावधान रखा जाना अनिवार्य होगा।

(i) If small commercial establishments/shops are part of a planned scheme, then the building standards shall be governed by the general rules for commercial buildings under clauses (i) and (ii). Otherwise, compliance with Table-01 will be mandatory.
If public parking provision has been made within the scheme, then for plots up to 50 sq. m., a separate parking provision shall not be required. For plots larger than 50 sq. m., provision for parking within the plot as per Table-16 shall be mandatory.


(ii) मुख्य सड़क से लगते हुए पंक्तिबद्ध (Row of Buildings/Plots) 500 व.मी. क्षेत्रफल तक वाणिज्यिक क्षेत्रों में अधिकतम 10 मी. (भूतल + 2 मंजिलों) के निर्माण हेतु साइड सैटबैक छोडा जाना अनिवार्य नहीं होगा एवं अग्र सैटबैक में बाउण्ड्री वॉल का निर्माण नहीं किया जावेगा। पार्किंग का प्रावधान तालिका-16 के अनुसार रखा जाना होगा।

(ii) For row buildings/plots adjoining the main road within commercial areas, up to 500 sq. m. plot area and up to a maximum building height of 10 m (Ground Floor + 2 Floors), it shall not be mandatory to leave a side setback, and no boundary wall shall be constructed in the front setback. Parking provisions shall be made as per Table-16.


(iii) 500 व.मी. क्षेत्रफल तक के वाणिज्यिक भूखण्डों में बेसमेंट में व्यावसायिक गतिविधि अनुज्ञेय नहीं होंगी।

(iii) In commercial plots up to 500 sq. m. area, commercial activities in the basement shall not be permissible.

10. अर्कोडेबल हाउसेज (Affordable Houses) :-

(i) राज्य सरकार द्वारा जारी मुख्यमंत्री जनआवास योजना/अफोर्डेबल हाउसिंग पॉलिसी के अनुसार समस्त मापदण्ड रखे जाने आवश्यक होंगे।

(i) All parameters shall be maintained in accordance with the Mukhyamantri Jan Awas Yojana / Affordable Housing Policy issued by the State Government.


(ii) पॉलिसी में वर्णित प्रावधानों के अतिरिक्त भवन निर्माण से संबंधित समस्त तकनीकी मापदण्ड इस विनियमो के अनुसार रखे जाने होंगे।

(ii) In addition to the provisions described in the policy, all technical parameters related to building construction shall be maintained as per these regulations.

9. रिटार्यमेन्ट हॉम्स (Retirement Homes) :-


(i) रिटार्यमेन्ट हॉम्स हेतु भूखण्ड का न्यूनतम क्षेत्रफल 1000 व.मी. एवं सड़क की चौडाई न्यूनतम 12 मीटर होना आवश्यक है।

(i) For retirement homes, the minimum plot area shall be 1000 sq. m. and the minimum road width shall be 12 metres.


(ii) रिटार्यमेन्ट हॉम्स हेतु कुल गणना योग्य क्षेत्रफल (बी.ए.आर) का न्यूनतम 15 प्रतिशत क्षेत्र सार्वजनिक सुविधाऐं यथा डाईनिंग एरिया, किचन, कॉमन टॉयलेट, पुस्तकालय, इनडोर गेम्स आदि हेतु रखा जाना आवश्यक होगा। उक्त सुविधाऐं केवल रिटार्यमेन्ट हॉम्स के लिये ही होगी।

(ii) A minimum of 15% of the total permissible floor area (B.A.R) for a retirement home shall be reserved for public facilities such as dining area, kitchen, common toilets, library, indoor games, etc. These facilities shall be exclusively for the use of the retirement home.


(iii) शेष अन्य भवन मापदण्ड आवासीय उपयोग के भवनों के अनुरूप देय होंगे।

(iii) All other building parameters shall be as applicable to buildings for residential use.


(iv) पार्किंग के प्रावधान तालिका-16 के अनुसार रखे जाने होगें।

(iv) Provision for parking shall be made as per Table–16.


(v) रिटार्यमेन्ट हॉम्स का आवंटन 60 वर्ष से अधिक आयु के व्यक्तियों के निवास हेतु ही किया जा सकेगा। 60 वर्ष से कम आयु के व्यक्ति को इसी शर्त पर आवंटन किया जा सकेगा कि वह 60 वर्ष की आयु के पश्चात् ही ऐसे आवास को रहवास हेतु उपयोग मे लेगें।

(v) Allotment of retirement homes shall be made only for residence by persons aged 60 years or above. A person below 60 years of age may be allotted such accommodation only on the condition that it will be used for residence after he/she attains the age of 60 years.


(vi) रिटार्यमेन्ट हॉम्स के आवासों को 60 वर्ष से अधिक आयु के व्यक्तियों को ही किराये पर दिया जा सकेगा।

(vi) The residential units in retirement homes may be rented only to persons aged 60 years or above.

8 हॉस्टल (Hostel) :-

(i) बडे शहरों में हॉस्टल भवन 500 व.मी. से अधिक क्षेत्रफल के भूखण्डों एवं सड़क की चौडाई न्यूनतम 12 मीटर होने पर अनुज्ञेय होंगे। लघु एवं मध्यम श्रेणी के शहरों में हॉस्टल भवन 300 व.मी. से अधिक क्षेत्रफल के भूखण्डों एवं सड़क की चौडाई न्यूनतम 09 मीटर होने पर अनुज्ञेय होंगे।

(i) In large cities, hostel buildings shall be permissible on plots having an area of more than 500 sq. m. with a minimum road width of 12 metres. In small and medium category cities, hostel buildings shall be permissible on plots having an area of more than 300 sq. m. with a minimum road width of 9 metres.

(ii) भवन मापदण्ड तालिका-1 के अनुरूप देय होंगे।

(ii) The building parameters shall be as per Table–1.

(iii) हॉस्टल हेतु वासयोग्य कमरों का न्यूनतम क्षेत्रफल 8 व.मी. प्रति छात्र / व्यक्ति रखा जाना अनिवार्य होगा।

(iii) For hostels, the minimum floor area of habitable rooms shall be 8 sq. m. per student/person.

(iv) हॉस्टल हेतु कुल गणना योग्य क्षेत्रफल (बी.ए.आर) का न्यूनतम 15 प्रतिशत क्षेत्र हॉस्टल की सार्वजनिक सुविधाऐं यथा डाईनिंग एरिया, किचन, कॉमन टॉयलेट, पुस्तकालय, इनडोर गेम्स आदि हेतु रखा जाना आवश्यक होगा। उक्त सुविधाऐं केवल हॉस्टल के छात्र/व्यक्तियों के लिये ही होगी।

2.77 ‘फायर टॉवर’ (Fire Tower) से आग प्रतिरोधक हेतु ऐसा परिवृत (Enclosed) क्षेत्र जो कि सीधा निकास से जुडा हो व भवन की संरचना से पृथक हो जिसमें संरक्षित लॉबी, सीढी और फायरमैन की लिफ्ट सम्मिलित हो, अभिप्रेत है।

2.77 ‘Fire Tower’ – Means an enclosed fire-resistant space directly connected to an exit and separated from the building structure, comprising a protected lobby, staircase, and fireman’s lift.


2.78 ‘ग्रीन बिल्डिंग्स’ (Green Buildings) :- से ऐसा भवन जिसका निर्माण पूर्ण कर लिया गया
हो तथा लीडरशिप इन एनर्जी एण्ड एन्वायरमेन्टल डिजाईन (LEED)/IGBC /GRIHA/ASSOCHAM GEM/EDGE के प्रावधानों के लिये प्रश्नगत भवन की अनुशंषा की गई हो अथवा ऐसी समतुल्य संस्थाएं/ तकनीकी विशेषज्ञ जिनकों ग्रीन बिल्डिंग के प्रमाणिकरण हेतु अधिकृत किया गया हों द्वारा प्लेटिनम / गोल्ड / सिल्वर रेटिंग दी गई हो, अभिप्रेत है।

2.78 ‘Green Buildings’ – Means a building that has been completed and recommended for certification under the provisions of Leadership in Energy and Environmental Design (LEED) / Indian Green Building Council (IGBC) / Green Rating for Integrated Habitat Assessment (GRIHA) / ASSOCHAM GEM / EDGE or any equivalent organisation / technical expert authorised for Green Building certification, and has been awarded a Platinum / Gold / Silver rating.


2.79 ‘टीडीआर’ (Transferable Development Right) से ऐसा अधिकार पत्र जो कि टी.डी आर पॉलिसी / नियमों के अंतर्गत सम्बन्धित निकाय द्वारा जारी किया गया हो, अभिप्रेत है।

2.79 ‘TDR’ (Transferable Development Right) – Means such a right document issued by the concerned authority under the TDR Policy / Rules.


2.80 ‘पूर्णता प्रमाण-पत्र’ (Completion Certificate) से अभिप्रेत ऐसे प्रमाण पत्र से है, जो विनियम संख्या 15 के प्रावधानों की पालना पूर्ण करने पर सक्षम अधिकारी द्वारा जारी किया जावे।

2.80 ‘Completion Certificate’ – Means a certificate issued by the Competent Authority upon compliance with the provisions of Regulation No. 15.

2.81 ‘अधिवास प्रमाण-पत्र’ (Occupancy Certificate) से अभिप्रेत ऐसे प्रमाण पत्र से है जो विनियम संख्या-15 की पालना पूर्ण करने पर सक्षम अधिकारी द्वारा जारी किया जाये।

2.81 ‘Occupancy Certificate’ – Means a certificate issued by the Competent Authority upon compliance with the provisions of Regulation No. 15.

2.82 ‘अनुसूची’ (Annexure) से इन विनियमों के साथ संलग्न अनुसूची, अभिप्रेत है।

2.82 ‘Annexure’ – Means the annexure(s) attached to these regulations.

नोट :-
(i) वे शब्द और अभिव्यक्तियों जो इन विनियमों में लिखी गई हैं किन्तु इनमें परिभाषित नहीं की गई हैं, उनका वही अर्थ होगा जैसा कि उनके लिए अधिनियम में निर्धारित किया गया है।
(ii) अन्य परिभाषायें जो यहां उल्लेखित नहीं है उनका वही अर्थ होगा जैसा उनके लिये राष्ट्रीय भवन संहिता (NBC) में निर्धारित किया गया है।

(i) Words and expressions used in these regulations but not defined herein shall have the same meaning as assigned to them in the Act.
(ii) Other definitions not mentioned herein shall have the same meaning as assigned to them in the National Building Code (NBC).

2.67 ‘बालकनी’ (Balcony) से आने जाने या बाहर बैठने के स्थान के रूप में काम आने वाला रेलिंग सहित क्षैतिज आगे निकला भाग जो कि न्यूनतम एक ओर से खुली हो, अभिप्रेत है।

2.67 ‘Balcony’ – Means a horizontal projection, with or without a railing, intended to be used as a passage or a sitting-out place, projecting from the wall of the building and open at least on one side.


2.68 ‘डबल हाईट टैरेस’ (Double Height Terrace) से बहुमंजिला आवासीय भवनों में आवासीय इकाई के किसी भी कमरे के बाहर स्थित ऐसा खुला क्षेत्र जो कि न्यूनतम 5.5 मीटर की ऊँचाई (डबल हाईट) का हो अभिप्रेत है।

2.68 ‘Double Height Terrace’ – Means an open area located outside any room of a residential unit in a multi-storeyed residential building having a minimum height of 5.5 metres (double height).


2.69 ‘बरामदा’ (Verandah) से ऐसा आच्छादित क्षेत्र जिसका कम से कम एक पार्श्व बाहर की ओर खुला हो व ऊपर की मंजिलों में खुले पार्श्व की ओर अधिकतम 1 मीटर ऊंचाई की पैरापेट खड़ी की गई हो, अभिप्रेत है।

2.69 ‘Verandah’ – Means a covered area with at least one side open to the exterior and, in upper floors, having a parapet wall of a maximum height of 1 metre on the open side.


2.70 ‘पैरापेट’ (Parapet Wall) से रेलिंग सहित या रहित छत या फर्श के सिरे के साथ-साथ निर्मित नीची दीवार जो 1.5 मीटर से अधिक तथा 0.75 मी. से कम ऊंचाई की नहीं हो, अभिप्रेत है।

2.70 ‘Parapet Wall’ – Means a low wall, with or without a railing, built along the edge of a roof or floor, the height of which shall not be more than 1.5 metres and not less than 0.75 metres.

2.71 ‘पार्टीशनवाल’ (Partition Wall) से भार सहन न करने वाली आन्तरिक दीवार, ऊंचाई में एक मंजिल या उसका भाग, अभिप्रेत है।

2.71 ‘Partition Wall’ – Means a non-load bearing internal wall, having the height of one storey or part thereof.


2.72 ‘पोर्च’ (Porch/Portico) से भवन के प्रवेश द्वार पर पैदल या वाहनों के लिये केन्टीलिवर / खम्बों पर निर्मित संरचना, अभिप्रेत है।

2.72 ‘Porch / Portico’ – Means a structure at the entrance of a building, constructed either cantilevered or supported on columns, for the passage of pedestrians or vehicles.


2.73 ‘ग्रीन एरिया / हरित क्षेत्र’ (Green Area) से ऐसा क्षेत्र जिसे हरियाली यथा ग्रास, पेड-पौधे, वृक्षारोपण, आदि हेतु उपयोग में लिया गया हो, अभिप्रेत है।

2.73 ‘Green Area’ – Means an area used for greenery, such as grass, shrubs, plantation, tree cover, etc.


2.74 ‘हैजार्डस भवन’ (Hazardous Building) से कोई ऐसा भवन या किसी भवन का कोई भाग जो अत्यधिक ज्वलनशील या विस्फोटक पदार्थों या उत्पादकों के जो अत्यधिक तेजी से जल उठने वाले अथवा जो विषैला धुंआ या विस्फोटक उत्पन्न करने वाले हो अथवा ऐसे भण्डारण उठाई, धराई, निर्माण या प्रसंस्करण के लिये जिसमें बहुत अधिक संक्षारक, विषैला या हानिकारक क्षार, अम्ल या कोई ऐसा अन्य द्रव्य अथवा रसायन काम आता हो जो ज्वाला, धुंआ और विस्फोट उत्पन्न कर सकते हो, विषैला प्रदाहजनक या संक्षारण गैस उत्पन्न कर सकते हो, अथवा ऐसी सामग्री जिसके भण्डारण उठाई, धराई या प्रसंस्करण से धूल का विस्फोटक मिश्रण उत्पन्न होता हो या पदार्थ को स्वतः ज्वलनशील सूक्ष्म अंशों में विभाजित करता हो, के भण्डारण, उठाई, धराई, निर्माण या प्रसंस्करण के लिये उपयोग में लिया जाता हो, अभिप्रेत है।

2.74 ‘Hazardous Building’ – Means a building or part thereof which is used for the storage, handling, manufacture or processing of highly combustible or explosive materials or products which are liable to catch fire rapidly, or which may produce poisonous fumes or explosives, or for the storage, handling, manufacture or processing of corrosive, toxic or harmful alkalis, acids or other materials or chemicals producing flame, smoke or explosive vapours, or producing poisonous, irritant or corrosive gases, or for the storage, handling or processing of materials producing dust of an explosive nature or materials which decompose spontaneously into dangerous quantities of fine particles.


2.75 ‘अग्निशमन अधिकारी’ (Fire Officer) से संबंधित नगरीय निकाय द्वारा प्राधिकृत अग्निशमन अधिकारी, अभिप्रेत है।

2.75 ‘Fire Officer’ – Means the Fire Officer authorised by the concerned Urban Local Body.


2.76 ‘शरण क्षेत्र’ (Refuge area) :- से भवन के अन्दर ऐसा क्षेत्र जो कि फायर और स्मॉक से सुरक्षा हेतु निकास के समय अस्थायी रूप से Staging Area (मचान क्षेत्र) के रूप में उपयोग में आता हो, अभिप्रेत है।

2.76 ‘Refuge Area’ – Means an area within a building intended to be used as a temporary staging area for the protection of occupants from fire and smoke during evacuation.

2.56 ‘स्टिल्ट फ्लोर’ (Stilt Floor) से खम्बों पर बना हुआ एवं खुला भू-तल जो कि मुख्य रूप से पार्किंग प्रयोजन हेतु निर्मित / प्रस्तावित हो, अभिप्रेत है।

2.56 ‘Stilt Floor’ shall mean an open ground floor constructed on columns, primarily built or proposed for parking purposes.

2.57 ‘पार्किंग फ्लोर (Parking Floor) से भवन में केवल पार्किंग उपयोग हेतु प्रस्तावित बेसमेंट, भूतल स्टील्ट या भवन के अन्य किसी भी तल से है जिसमें न्यूनतम 70 प्रतिशत क्षेत्र केवल पार्किंग, सीढियों, लिफ्ट व सर्कुलेशन आदि हेतु एवं अधिकतम 30 प्रतिशत क्षेत्र विनियमों में अनुज्ञेय भवन की सविर्सेज, सुविधाओं व भूतल स्टील्ट पर अनुज्ञेय अन्य गतिविधियों के लिए दिया गया हो, अभिप्रेत है।

2.57 ‘Parking Floor’ shall mean any floor in a building — whether in the basement, ground floor stilt, or any other floor — proposed exclusively for parking use, wherein a minimum of 70% of the floor area is utilised for parking, staircases, lifts, and circulation, and a maximum of 30% of the floor area is utilised for services, facilities, or other activities permissible on the ground or stilt floor under the regulations.

2.58 ‘पार्किंग स्थल/क्षेत्र (Parking Site/Area) से वाहनों को पार्क करने के लिये पर्याप्त आकार का स्थल / क्षेत्र जो किसी गली या रास्ते / रैम्प से जोड़ने वाले वाहन मार्ग सहित अहातायुक्त/अहातारहित कोई क्षेत्र चाहे वह आच्छादित हो अथवा खुला हो, अभिप्रेत है।

2.58 ‘Parking Site / Parking Area’ shall mean a plot or area of adequate size for parking vehicles, with or without an enclosure, whether covered or open, including the vehicular access from a street, lane, path, or ramp.

2.59 ‘समतुल्य कार इकाई (Equivelant Car Unit)’ से एक कार या तीन स्कूटर के बराबर, अभिप्रेत है।

2.59 ‘Equivalent Car Unit (ECU)’ shall mean the equivalent of one car or three scooters.

2.60 ‘मेकेनिकल पार्किंग’ (Mechanical Parking) से वाहनों की रोबोटिक अथवा यांत्रिक संरचना द्वारा संचालित कार के ऊपर कार पार्किंग, अभिप्रेत है।

2.60 ‘Mechanical Parking’ shall mean a car parking system operated by robotic or mechanical devices, enabling car-on-car parking arrangements.

2.61 ‘वास योग्य कमरा (Habitable Room) से ऐसा कमरा जो एक या एक से अधिक व्यक्तियों द्वारा अध्ययन, रहवास, सोने या खाने के प्रयोजनार्थ अधिवास में लिया हुआ हो या अधिवास हेतु परिकल्पित हो किन्तु इसमें स्नानघर, शौचालय, लॉन्ड्री, भोजन सेवा, भण्डारण, गेलेरी, रसोई, जिनका ज्यादातर समय उपयोग नहीं किया जाता है सम्मिलित नहीं होंगे, अभिप्रेत है।

2.61 ‘Habitable Room’ shall mean a room intended or designed for occupancy by one or more persons for the purposes of study, living, sleeping, or eating, but shall not include bath rooms, water-closets, laundries, serving pantries, storage rooms, galleries, kitchens or spaces which are not normally occupied for extended periods.

2.62 ‘शौचालय’ (Toilet) से ऐसा स्थान, जो कि मल या मूत्र त्यागने के लिए या दोनों के लिए हो, उसमें मनुष्यमल के लिये संयोजिकृत पात्र यदि कोई हो, के साथ की संरचना, अभिप्रेत है।

2.62 ‘Toilet’ shall mean a space intended for use for defecation or urination, or both, together with the necessary fittings and structure, if any, for the disposal of human excreta.

2.63 ‘खुला स्थान’ (Open to Sky) से भूखण्ड का वह भाग जो आकाश की ओर खुला हो या पारदर्शी अथवा अर्धपारदर्शी मटिरियल से ढका हो, अभिप्रेत है।

2.63 ‘Open to Sky’ shall mean a portion of the plot that is open to the sky or covered with transparent or semi-transparent material.

2.64 ‘ऐट्रियम’ (Atrium) से किसी भी प्रकार के भू-उपयोग के भूखण्ड पर किसी भी तल पर प्रस्तावित निर्माण जिसमें एक केन्द्रीय कक्ष जिसकी ऊँचाई 10 मीटर या उससे अधिक हो एवं उक्त क्षेत्र को स्काई लाईट / ट्रस्स अथवा डोम (अस्थाई स्ट्रकचर) से ढका गया हो, अभिप्रेत है।

2.64 ‘Atrium’ shall mean a central hall or space in any building, of any permitted land use, having a height of 10 metres or more, and covered by a skylight, truss, or dome (temporary structure).

2.65 ‘छज्जा’ (Projection/Chajja) से सामान्यतया बाहरी दीवारों पर खुलने वाले स्थानों के ऊपर धूप तथा वर्षा से बचाव के प्रयोजनार्थ बनाये जाने वाली ढलवा अथवा क्षैतिज संरचना, अभिप्रेत है।

2.65 ‘Chajja’ shall mean a sloping or horizontal structure generally constructed over openings on external walls, for protection against sun and rain.

2.66 ‘प्रोजेक्शन’ (Projection) से किसी भी भवन से बाहर निकली हुई कोई संरचना, (जो किसी भी सामग्री की हो) अभिप्रेत है।

2.66 ‘Projection’ shall mean any structure projecting beyond the external face of a building, of any material.

2.47 ‘रोड लेवल’ (Road Level) से भूखण्ड के सामने की मुख्य सड़क के मध्य की ऊंचाई का लेवल अभिप्रेत है जिस पर भूखण्ड स्थित है, यदि भूखण्ड के सामने की सड़क ढलान में है तो भूखण्ड के सामने स्थित रोड का उच्चतम लेवल, अभिप्रेत है।
2.48 ‘सड़क की चौड़ाई’ (Road Width/Road Right of Way) से भूखण्ड के सामने स्थित विद्यमान सड़क की लंबाई में एक छोर से दूसरे छोर तक की औसत चौड़ाई अथवा मास्टर प्लान / जोनल डवलपमेंट प्लान/अन्य स्वीकृत प्लान में प्रस्तावित मार्गाधिकार, अभिप्रेत है।
2.49 ‘भूमि स्तर’ (Ground Level) से भूखण्ड या स्थल का औसत तल, अभिप्रेत है।
2.50 ‘कुर्सी’ (Plinth) से भू-तल फर्श के धरातल और भूखण्ड के सामने के मुख्य सडक के तल के बीच की संरचना का भाग, अभिप्रेत है।
2.51 ‘कुर्सी क्षेत्र’ (Plinth Area) से भवन के बेसमेन्ट की छत या भू-मंजिल के फर्श के स्तर पर निर्मित आच्छादित क्षेत्र, अभिप्रेत है।
2.52 ‘बेसमेन्ट’ (Basement) से भवन का ऐसा भाग जिसे पूर्णतः या आंशिक रूप से भू-सतह के नीचे निर्मित किया गया हो, अभिप्रेत है।
2.53 ‘मंजिल’ (Storey) से किसी भवन का वह भाग जो किसी फर्श की सतह और उसके ठीक ऊपर के फर्श की सतह के मध्य स्थित है अथवा जहां उसके ऊपर कोई फर्श नहीं, वहां किसी फर्श तथा ठीक उसके ऊपर की छत के मध्य का स्थान, अभिप्रेत है।
2.54 ‘मैजनाईन फ्लोर’ (Mezzanine Floor) से भूतल अथवा किसी भी तल एवं इससे ऊपर की किन्हीं दो तलों के बीच एक मध्यवर्ती मंजिल जो कि भूमि तल से ऊपर हो एवं जिसका प्रवेश केवल निचली मंजिल से हो तथा जिसका फर्श क्षेत्र संबंधित कमरे के क्षेत्रफल का एक तिहाई से अधिक न हो एवं स्पष्ट ऊँचाई 2.4 मी. से कम न हो, अभिप्रेत है।
2.55 ‘सर्विस फ्लोर’ (Service Floor) से किसी बहुमंजिला भवन में स्थित किन्ही दो मंजिलों के बीच अधिकतम 2.4 मीटर ऊँची मंजिल / फ्लोर जो कि केवल भवन से संबंधित पाइप, सर्विस डक्ट, रख-रखाव कार्यालय अथवा भवन के उपयोग संबंधित सुविधाओं के भण्डारण इत्यादि के उपयोग में लिया जाये, अभिप्रेत है।

2.47 ‘Road Level’ shall mean the level of the centre of the main road in front of the plot on which the plot is situated. In case the road in front of the plot is on a slope, the highest level of the road in front of the plot shall be taken as the road level.

2.48 ‘Road Width / Road Right of Way’ shall mean the average width of the existing road in front of the plot measured from one end to the other along its length, or the right of way as proposed in the Master Plan / Zonal Development Plan / other approved plan.

2.49 ‘Ground Level’ shall mean the average level of the plot or site.

2.50 ‘Plinth’ shall mean the portion of the structure between the surface of the ground floor and the level of the main road in front of the plot.

2.51 ‘Plinth Area’ shall mean the built-up covered area measured at the basement roof level or at the ground floor level of the building.

2.52 ‘Basement’ shall mean the portion of a building that is wholly or partly constructed below the ground level.

2.53 ‘Storey’ shall mean the portion of a building included between the surface of one floor and the surface of the floor next above it; or, if there is no floor above, the space between the floor and the ceiling immediately above.

2.54 ‘Mezzanine Floor’ shall mean an intermediate floor between the ground floor or any other floor and the floor above, which is situated above the ground level, has access only from the floor below, does not exceed one-third of the floor area of the room in which it is constructed, and has a clear height of not less than 2.4 metres.

2.55 ‘Service Floor’ shall mean a floor having a maximum height of 2.4 metres, constructed between two floors in a multi-storeyed building, and used exclusively for housing pipes, service ducts, maintenance offices, or storage of facilities related to the use of the building.

2. परिभाषाएँ (Definitions)

2.37 ‘औद्योगिक भवन’ (Industrial Building) से कोई भवन या किसी भवन की संरचना का भाग (अनुसूची-1 के क्रम. सं. 5 पर उल्लेखित भवनों की प्रकृति के अनुसार प्रस्तावित /निर्मित भवन) जिसमें किसी भी प्रकार की सामग्री बनाई, संयोजित या प्रसंस्कृत की जाती हो, अभिप्रेत है।

2.37 “Industrial Building” means any building, or part of the structure of a building (proposed/constructed as per the nature of buildings mentioned at Serial No. 5 of Schedule-1) in which any type of material is manufactured, assembled, or processed.


2.38 ‘मिश्रित उपयोग ‘(Mixed Use) से ऐसा भवन/भूखण्ड अथवा भवन परिसर जिसमें आवासीय, वणिज्यिक, पर्यटन इकाइ व संस्थागत उपयोग साथ अथवा पृथक-पृथक मंजिलों पर निर्मित / प्रस्तावित हो, अभिप्रेत है।

2.38 “Mixed Use” means such a building/plot or building complex in which residential, commercial, tourism units, and institutional uses are proposed/constructed together or separately on different floors.


2.39 ‘सैटबैक’ (Setback) से उन न्यूनतम दूरियां जो भू-खण्ड की सीमा रेखाओं से भू-खण्ड के अन्दर विधिपूर्वक किसी भवन की कुर्सी का निर्माण किया जा सकता है, अभिप्रेत है।
किसी भू-खण्ड के सामने स्थित सबसे चौडी सड़क की तरफ (i) सामने के सैटबेक लगने वाली सीमा से भवन रेखा की दूरी अभिप्रेत है।
(ii) पार्श्व सैटबेक किसी भू-खण्ड के पार्श्व सीमा से भवन रेखा की दूरी अभिप्रेत है।
(iii) पीछे के सैटबेक अभिप्रेत है। किसी भू-खण्ड के पीछे की सीमा से भवन रेखा की दूरी

2.39 “Setback” means the minimum distances from the plot boundary lines within which the plinth of any building may be constructed in accordance with the law.
(i) Front Setback means the distance between the front boundary (abutting the widest road facing the plot) and the building line.
(ii) Side Setback means the distance between the side boundary of the plot and the building line.
(iii) Rear Setback means the distance between the rear boundary of the plot and the building line.


2.40 ‘भवन रेखा’ (Building Line) से वह रेखा जहां तक भवन कुर्सी का विधि पूर्वक विस्तार हो सकता है, अभिप्रेत है।

2.40 “Building Line” means the line up to which the plinth of the building may be lawfully extended.


2.41 ‘सकल निर्मित क्षेत्र’ (Gross Builtup Area) से किसी भी भवन की समस्त मंजिलों पर प्रस्तावित निर्मित क्षेत्र का कुल योग, अभिप्रेत है।

2.41 “Gross Built-up Area” means the total proposed built-up area on all floors of any building.


2.42 ‘गणना योग्य निर्मित क्षेत्र’ (Net Builtup Area) से विनियम संख्या-4.14 (viii) के अनुसार सकल निर्मित क्षेत्र में से अनुज्ञेय छूट के पश्चात् प्राप्त निर्मित क्षेत्र अभिप्रेत है।

2.42 “Net Built-up Area” means the built-up area obtained after deducting the permissible exemptions from the Gross Built-up Area as per Regulation No. 4.14 (viii).


2.43 ‘बी.ए.आर.’ (Builtup Area Ratio) से सभी मंजिलों के विनियम संख्या-4.14 (viii) के अनुसार गणना योग्य निर्मित क्षेत्रफल को भूखण्ड के क्षेत्रफल से भाग देने पर प्राप्त भागफल, अभिप्रेत है।

2.43 “Built-up Area Ratio (B.A.R.)” means the quotient obtained by dividing the Net Built-up Area (as per Regulation No. 4.14 (viii)) of all floors by the plot area.


2.44 ‘भू-आच्छादन’ (Ground Coverage) से विनियम संख्या 4.13 के अनुसार भूमि का आच्छादित क्षेत्र जो कुर्सी तल के एवं यदि भवन स्टिल्ट अथवा पोडियम पर निर्मित / प्रस्तावित है तो ठीक उसके ऊपर भवन द्वारा आच्छादित तल क्षेत्र, अभिप्रेत है।

2.44 “Ground Coverage” means the covered area of the land as per Regulation No. 4.13, which is the plinth area at ground level, and in case the building is constructed/proposed on stilts or a podium, the floor area directly above it covered by the building.


2.45 ‘भवन की ऊँचाई (Building Height) का निर्धारण प्लिंथ की ऊँचाई (अधिकतम 1.2 मीटर) अथवा स्टिल्ट प्रस्तावित होने पर स्टिल्ट की छत (अधिकतम 3.5 मीटर) से भवन की अंतिम छत (टेरेस) (सर्विस फ्लोर, मध्यवर्ती तलों पर पार्किंग फ्लोर सहित) तक की ऊँचाई से, अभिप्रेत है।

2.45 “Building Height” shall be determined as the height from the plinth level (maximum 1.2 metres) or, where stilt is proposed, from the roof of the stilt floor (maximum 3.5 metres) up to the top of the final roof (terrace), including service floors and parking floors on intermediate levels.

2.46 ‘बहुमंजिला भवन’ (Multistorey Building) ऐसा भवन जिसकी अधिकतम ऊँचाई 15 मी. (सर्विस फ्लोर, मध्यवर्ती तलों पर पार्किंग फ्लोर सहित) से अधिक हो, अभिप्रेत है। अधिकतम 1.2 मीटर प्लिंथ एवं अधिकतम 3.5 मीटर स्टिल्ट की ऊँचाई की गणना भवन की कुल ऊँचाई में सम्मिलित नहीं होगी।

2.46 “Multistorey Building” means a building having a total height exceeding 15 metres (including service floors and parking floors on intermediate levels). The maximum plinth height of 1.2 metres and maximum stilt height of 3.5 metres shall not be included in the calculation of the total building height.
