17 Occupancy Certificate

17 अधिवास प्रमाण-पत्र

17.1. After completing the construction of the building in accordance with the approved map and obtaining the Completion Certificate, the developer must apply for an Occupancy Certificate from the competent officer/State Government registered architect for the arrangement of necessary facilities such as electricity, water, sewerage treatment plant, transformer, architectural finishing such as painting, false ceiling, interior site development, parking signage, landscaping, plantation, etc. The Occupancy Certificate must be obtained within 3 months of its issuance by the Environmental Department on Consent to Operate.

17.1. अनुमोदित मानचित्र के अनुसार भवन निर्माण पूर्ण कर पूर्णता प्रमाण पत्र प्राप्त करने के पश्चात् भवन में आवश्यकसुविधाएं यथा बिजली, पानी, सीवरेज ट्रीटमेंट प्लान्ट ट्रांसफार्मर, आर्केटेक्चरल फिनिशिंग यथा पेन्टिंग, फाल्स सिलिंग, इंटिरियर साइट डवलेपमेन्ट, पार्किंग साईनेजेज, लेण्डस्केपिंग, प्लांटेशन आदि की व्यवस्था करने के पश्चात् विकासकर्ता द्वारा सक्षम अधिकारी/राज्यसरकार द्वारा इस हेतु पंजीकृत वास्तुविद के समक्ष अधिवास प्रमाण पत्र हेतु आवेदन करना होगा। अधिवास प्रमाण-पत्र जारी होने के 3 माह के अंदर Consent to Operate पर्यावरण विभाग से प्राप्त किया जाना अनिवार्य होगा।

17.2. The Occupancy Certificate will be issued by the competent officer/registered architect within 7 days of receiving the application, after necessary inspection.

17.2. उक्त आवेदन प्राप्त होने के 7 दिवस की अवधि में सक्षम अधिकारी/पंजीकृत वास्तुविद् द्वारा आवश्यकजाँच कर अधिवास प्रमाण पत्र जारी किया जावेगा।

17.3. For all types of multi-storey buildings and specific buildings, the occupancy certificate can only be issued after the final no-objection certificate from the fire officer. In cases where environmental clearance is mandatory, the clearance from the Environmental Department must also be submitted before the applicant can receive the occupancy certificate.

17.3. सभी प्रकार के बहुमंजिले भवनों के लिए तथा विशिष्ठ भवनों के लिए अग्निशमन अधिकारी से अंतिम संतुति पत्र जारी होने के बाद ही अधिवास प्रमाण-पत्र जारी किया जा सकेगा। जिन प्रकरणों में पर्यावरण अनापत्ति लेना अनिवार्य है ऐसे मामलों में पर्यावरण विभाग की अनापत्ति भी आवेदक द्वारा अधिवास प्रमाण-पत्र प्राप्त करने से पूर्व प्रस्तुत करनी होगी।

17.4. As per the Real Estate (Regulation and Development) Act, 2016 and the Rajasthan Real Estate (Regulation and Development) Rules, 2017 made thereunder, obtaining an occupancy certificate will be necessary for the mentioned buildings.

17.4. रियल एस्टेट (रेगुलेशन एण्ड डवलपमेंट) अधिनियम, 2016 एवं इसके तहत बनाये गये राजस्थान रियल एस्टेट (रेगुलेशन एण्ड डवलपमेंट) नियम, 2017 के प्रावधानों में उल्लेखित भवनों हेतु अधिवास प्रमाण-पत्र प्राप्त करना आवश्यक होगा।
