10.7. Setback :

10.7. सैंटबेक :

(i) The determination of setback for a plot will from the boundary of the plot. The setback for the sides and rear of the plot will be determined as per Table-1. In all plots, front setbacks as per scheme otherwise based on the width of the road according to following tables.

(i) सैटबैंक का निर्धारण भूखण्ड की बाउण्ड्री से होगा। भूखण्डो पर साईड व पीछे के सैंटबेक तालिका 1 के अनुसार निर्धारित किये जावेगे। समस्त भूखण्डों में अग्र सैटबेक योजनानुसार अन्यथा सड़क की चौड़ाई के आधार पर निम्न तालिकाओं के अनुसार रखे जावेंगे।

Note: If the building line has been determined for a road by the local authority, then the front setback can be placed accordingly.

It will be mandatory for all local bodies to determine the building line of each road in the urban area, taking into account the right of way of each existing road and the existing constructions on each road. For plots of up to 90 square meters located on roads of any width, a front setback will not be mandatory. For plots with an area greater than 90 square meters and up to 167 square meters, a minimum front setback of 3.0 meters will be required. (Amendment according to UDH order number 11 (9) UDH/2020 dated 13^th March 2022)

नोट:-स्थानीय निकाय द्वारा कसी सड़क हेतु भवन रेखा निर्धारित की गयी है तो तदानुसार अग्र सेटबैक रखा जा सकेगा।

समस्त स्थानीय निकायों द्वारा नगरीय क्षेत्र में विद्यमान प्रत्येक सडक का मार्गाधिकार एवं प्रत्येक सड़क पर स्थित विद्यमान निर्माणों को दृष्टिगत रखते हुये भवन रेखा का निर्धारण किया जाना अनिवार्य होगा। समस्त चौडाई की सडकों पर स्थित 90 वर्गमीटर क्षेत्रफल तक के भूखण्डों पर अग्र सैटबैक अनिवार्य नहीं होगा, 90 वर्गमीटर से अधिक 167 वर्गमीटर क्षेत्रफल तक के भूखण्डों पर न्यूनतम अग्र सैटबैक 3.0 मीटर रखा जावेगा। ( संशोधित नविवि आदेश 11 (9) नविवि/2020 दिनांक 13^th MAR 2022)

(ii) If the shape of the plot is such that there is no congruity with other setback lines determined for adjacent plots while defining the setback line from the boundary of the plot, the competent authority may determine the setback line separately, taking into account the setback lines of other buildings in the vicinity. Typically, the front setback of the plot will be towards the wider road, and the determination of the proposed height of the building can be made in relation to that road.

(ii) यदि भूखण्ड काआकार इस प्रकार है जिससे भूखण्ड की बाउण्ड्री से अग्र सैट बैंक की लाइन निर्धारित करने में समीपस्थ भूखण्डो के लिए निर्धारित अन्य सैट बैंक लाईन से समरूपता नहीं बनती है तो सक्षम अधिकारी द्वारा अनुशंषा किये गये अब सैटबेक आसपास के भवनों के अन्य सैटबेक को देखते हुए अलग से निर्धारित किया जा सकेगा। सामान्य तौर पर भूखण्ड का अग्र सेटबेक चौड़ी सड़क की ओर होगा व भवन की प्रस्तावित ऊँचाई का निर्धारण उसी सड़क के परिप्रेक्ष्य में किया जा सकेगा।
