5.4 Provision for previously approved plan areas in S-4 zone:

5.4 एस-4 क्षेत्र में पूर्व स्वीकृत योजना क्षेत्रों हेतु प्रावधान:-

1) The previously approved building maps can be exempted from these regulations before they are applied or can be removed as per the provisions of previous rules or on the submission of a new application by the applicant, and it is not necessary to remove, change or increase the approved construction as per current regulations/standards that has been completed or is under construction, with the implementation of these regulations.

1) इन विनियमों के लागू होने से पूर्व आवेदित भवन मानचित्र अनुमोदन के प्रकरण पूर्व नियमों के प्रावधानों के अनुसार अथवा आवेदक द्वारा पुनः आवेदन प्रस्तुत करने पर इन विनियमों के अंतर्गत निस्तारित किये जा सकेंगे तथा तत्कालीन विनियमों/नियमों के अनुरूप निर्धारित मानदण्डों के अनुसार स्वीकृत निर्माण को जो या तो पूरा हो चुका है या निर्माणाधीन है, इन विनियमों के लागू होने के साथ हटाने, परिवर्तन या परिवर्धन करने की आवश्यकता नहीं। होगी।

2) Construction approval can be given based on the type design of the schemes in which the type design is specified. However, if additional construction is proposed/allowed that is different from the type design, betterment charges will be levied as per the rules for additional construction.

2) जिन योजनाओं में टाइप डिजाईन निर्धारित है उनके टाईप डिजाईन के आधार पर निर्माण स्वीकृति दी जा सकेगी तथापि टाईप डिजाईन से भिन्न/अतिरिक्त निर्माण प्रस्तावित / अनुज्ञेय किये जाने पर अतिरिक्त निर्माण हेतु नियमानुसार बेटरमेट लेवी देय होगी।

3) Previous approved special plans, such as the Vidhyadhar plan in Jaipur, will have specific architectural standards determined by the local authority in that area. These standards will be applied in the relevant special plan.

3) पूर्व स्वीकृत विशिष्ट योजनाएँ जैसे जयपुर की विद्याधर योजना जिसके लिए विशिष्ट वास्तुविदिक मापदण्ड संबंधित स्थानीय निकाय द्वारा निर्धारित हो उस योजना में संबंधित विशिष्ट वास्तुविदिक मापदण्ड लागू होंगे।

4) In the case of previous approved plans for land :-

4) पूर्व स्वीकृत योजना भूखण्डों में :-

(i) According to the applicable building regulations at the time of project approval/auction/allotment or according to the current building regulations, permission for construction approval building extension can be granted if allocated/sold by auction in approved schemes of local bodies/private developers. . But all the due fees will be payable as per the existing building regulations, if the construction done in the building is permissible under the existing regulations, then the revised building map can be approved.

(i) स्थानीय निकाय/निजी विकासकर्ताओं की स्वीकृतयोजनाओं में आवंटित / नीलामी द्वारा विक्रय जाने पर परियोजना स्वीकृति/नीलामी / आवंटन के समय लागू भवन विनियमों के अनुसार अथवा वर्तमान भवन विनियमों के अनुसार समस्त मानदण्ड रखते हुए निर्माण स्वीकृति भवन विस्तार की अनुमति दी जा सकेगी। लेकिन समस्त देय शुल्क वर्तमान भवन विनियमों के अनुसार देय होंगे यदि भवन में किया गया निर्माण वर्तमान नियमों के तहत अनुज्ञेय है तो संशोधित भवन मानचित्र अनुमोदन किया जा सकेगा।

(ii) The building construction approval/extension on the plot/building mentioned in clause 4(i) can be granted as per the current building regulations upon fulfillment of the following conditions proposed by the applicant.

(ii) विनियम संख्या 4(i) में उल्लेखित भूखण्ड /भवन पर आवेदक द्वारा प्रस्तावित करने पर भूखण्ड/भवन पर भवन निर्माण स्वीकृति/विस्तार की अनुमति वर्तमान भवन विनियमों के अनुसार निम्न शर्तों की पूर्ति करने पर दी जा सकेगी:-

(a) If  the plot is vacant or the existing building is to be demolished and a new building is proposed, then approval for the construction/extension of the building must be in accordance with current building regulations. The applicant must have sole ownership of the plot and the units (if constructed) on it, meaning that the sale/allotment/transfer of any part of the plot or building constructed on it to any other person should not have been done through any registered/unregistered documents. However, if all the unit owners of the constructed building apply collectively or through an authorized person/institution/developer, then approval for building construction/extension can be granted as per the rules. The concerned urban local body can also identify such buildings/sites/plans/areas and implement redevelopment plans through private developers or at its own level.

(क) भूखण्ड रिक्त हो अथवा पूर्व में स्थित निर्माण को ध्वस्त कर नया निर्माण किया जाना प्रस्तावित हो तो वर्तमान भवन विनियमों के अनुरूप भवन निर्माण/विस्तार की स्वीकृति देय होगी। भूखण्ड एवं उस पर निर्मित भवन इकाईयों (यदि निर्मित हो) पर आवेदक का एकल स्वामित्व हो अर्थात भूखण्ड या उस पर निर्मित भवन के किसी भाग का विक्रय/आवंटन / किसी पंजीकृत / अपंजीकृत दस्तावेज द्वारा किसी अन्य व्यक्ति को नहीं किया गया हो। तथापि यदि निर्मित भवन इकाईयों के समस्त स्वामी सामूहिक रूप से अथवा समस्त स्वामियों की तरफ से अधिकृत व्यक्ति/संस्था/विकासकर्ता के माध्यम से आवेदन किया जाता है तो नियमानुसार भवन निर्माण स्वीकृति/विस्तार की अनुमति दी जा सकेगी। सम्बन्धित नगरीय निकाय द्वारा भी ऐसे भवनों / परिसरों/ योजनाओं/क्षेत्रों को चिन्हित किया जाकर निजी विकासकर्ता के माध्यम से अथवा स्वयं के स्तर से पुर्नविकास की योजनायें क्रियान्वित की जा सकेगी।

(b) Minimum front setback, fundamental plot/project approval or whatever is more as per the current building regulations, will be applicable. Other setbacks will be applicable as per the prevailing building regulations.

(ख) न्यूनतम अग्र सैटबेक मूल भूखण्ड/ परियोजना स्वीकृति के अनुसार निर्धारित अथवा वर्तमान भवन विनियमों के अनुसार जो भी अधिक हो रखने होंगे। अन्य सैटबेक वर्तमान प्रचलित भवन विनियमों के अनुसार देय होंगे।

(c) At the time of project approval, if the required land acquisition, height or F.A.R. exceeds the current building regulations, the previously approved total built-up area will be considered as the standard built-up area, and betterment levy will be payable on the additional proposed built-up area in accordance with the rules. However, exemptions related to the state government’s other prevailing policies such as the Chief Minister’s Housing Scheme, Tourism Policy, etc. will be applicable as per the state government’s decision.

(ग) पूर्व में परियोजना स्वीकृति के समय देय भू-आच्छादन, ऊँचाई या एफ.ए.आर. से अधिक भू- आच्छादन ऊँचाई या एफ. ए. आर. वर्तमान भवन विनियमों के अनुसार अनुज्ञेय किये जाने पर पूर्व में स्वीकृतयोग्य सकल निर्मित क्षेत्र को मानक निर्मित क्षेत्र माना जाकर अतिरिक्त प्राप्त प्रस्तावित होने वाले निर्मित क्षेत्र पर नियमानुसार बेटरमेंट लेवी देय होगी तथापि राज्य सरकार की अन्य प्रचलित नीति यथा मुख्यमंत्री जन आवास योजना, पर्यटन नीति आदि से संबंधित छूट राज्य सरकार के निर्णय अनुसार ही देय होगी।

(d) All other standards/parameters must be maintained in accordance with current regulations.

(घ) अन्य समस्त मानदण्ड वर्तमान विनियमों के अनुसार रखने होंगे।

(i) These are the building regulations under the Rajasthan Real Estate (Development and Regulation) Rules, 2017, which must be followed while carrying out any real estate development project in Rajasthan.

(i) राजस्थान रियल एस्टेट ( डवलपमेन्ट एण्ड रेगुलेशन) रुल्स – 2017 के अन्तर्गत पंजीकृत परियोजनाओं में संशोधन हेतु आवेदन करने पर संबंधित नियमों की अनुपालना सुनिश्चित करनी होगी।

(ii) Registered projects must comply with the relevant rules when applying for modifications.

(iv) In the case of previously approved projects or site plans that do not mention any setback, built-up area, height, or F.A.R. criteria, all such criteria will be as per the building regulations.

(iv) पूर्व स्वीकृत योजनाओं अथवा साईट प्लान जिसमे सैटबेक, आच्छादित क्षेत्र, ऊँचाई या एफ. ए. आर के किसी मापदण्ड या मापदण्डों का उल्लेख/निर्धारण नहीं हो तो जिन मापदण्डों का उल्लेख नहीं है वो सभी मापदण्ड इन भवन दिनियमों के मापदण्डों के अनुसार होंगे।

(v) If the construction of a project was proposed in different stages, the construction of the next phase will be in accordance with these regulations after the previous phase is completed as per the applicable regulations.

(v) पूर्व में किसी परियोजना का निर्माण विभिन्न चरणों में प्रस्तावित होने पर, एक चरण पूर्व में लागू विनियमों के तहत पूर्ण होने पर अगला चरण का निर्माण इन विनियमों के अनुरूप किया

(vi) Permissible use outside the urbanisation area of ​​the master plan of cities/towns, within the periphery control area/urbanisable area such as: Design of hotel/resort/motel/farm house/institution etc. included in the urbanisation area of ​​the approved master plan. Permission for construction of a building in accordance with the approved land use for the appropriate urbanisable area. It can be given as follows:

(vi) नगरों/कस्बों के मास्टर प्लान के नगरीयकरण क्षेत्र के बाहर परिधि नियन्त्रण क्षेत्र/नगरीयकरण योग्य क्षेत्र की सीमा में अनुज्ञेय उपयोग यथा: होटल/रिसोर्ट/मोटल/फार्म हाउस/संस्थान आदि का प्रारूप / अनुमोदित मास्टर प्लान के नगरीयकरण क्षेत्र में सम्मिलित होने के पश्चात नगरीयकरण योग्य क्षेत्र में अनुज्ञेय भूउपयोग के अनुरूप भवन निर्माण स्वीकृति विस्तार की अनुमति निम्नानुसार दी जा सकेगी-

1. Single plot of land – In the case landuse in accordance with previously approved land use and maintaining buildings parameter.

1. एकल भूखण्ड – पूर्व में अनुमोदित उपयोग के अनुरूप अनुज्ञेय किये गये भवन मानदण्ड यथावत रखने की स्थिति में

(i) no betterment levy will be payable if the entire constructed area/height/covered area approved previously exists on the plot.
(ii) If a new construction proposal is made, building construction permit fees or otherwise amendment fees will be payable.
(iii) In the case of land-use designated is different from assigned land-use, fees will be payable in accordance with the rules.
(iv) Other fees as per regulations will be payable.

(i) भूखण्ड पर पूर्व में अनुमोदित सकल निर्मित क्षेत्र / ऊँचाई / आच्छादितक्षेत्र होने पर कोई बेटरमेंट लेवी देय नहीं होगी।

(ii) यदि नया निर्माण प्रस्तावित है तो भवन निर्माण अनुज्ञा शुल्क अन्यथा संशोधन शुल्क देय होगा।

(iii) पूर्व में निर्धारित भू- जाने की स्थिति में नियमानुसार शुल्क देय होगा।उपयोग से भिन्न उपयोग निर्धारण किये

(iv)अन्य नियमानुसार वसूलनीय शुल्क देय होगा।

1. Single plot of land – In the case of landuse is different previously approved land use and maintaining buildings parameter in accordance with current building regulations

2. एकल भूखण्ड – पूर्व में अनुज्ञेयअनुमोदित उपयोग से भिन्न उपयोग एवं वर्तमान भवन विनियमों के अनुसार भवन मानदण्ड रखने की स्थिति में

(i) Previous approved gross builtup area will be taken as the standard Built-up Area (B.U.A.) and their will be betterment levy on additional proposed builtup area.

For example, if a resort had a 20% coverage and a 0.60 FAR (Floor Area Ratio) approved for a single plot of land, and is used for residential purposes, no Betterment Levy would be required if the building parameter are maintained appropriately. However, if the proposed construction has a 40% coverage and 2.0 FAR for residential use, an additional Betterment Levy will be required for the excess constructed area (FAR) according to regulations.

(ii) The proposed landuse is different from previous land-use then charges as per regulations

(iii) Building permit fees and other charges will be applicable.

(iv) Other applicable charges as per regulations will also be required.

(i) पूर्व में स्वीकृति योग्य कुल सकल निर्मित क्षेत्र को मानक बी. ए. आर. माना जाकर अतिरिक्त प्रस्तावित निर्माण पर नियमानुसार बेटरमेट लेवी देय होगी।

उदाहरणार्थ:- रिसोर्ट एकल भूखण्ड में 20 प्रतिशत आच्छादन एव बी.ए.आर 0.60 देय था का आवासीय भू-उपयोग किये जाने पर भवन मानदण्ड यथावत रखे जाने पर कोई बेटरमेंट लेवी देय नहीं होगी, किन्तु आवासीय भू- उपयोग हेतु देय भवन मानदण्ड 40 प्रतिशत आच्छादन 2.0 बी.ए.आर प्रस्तावित किये जाने पर अतिरिक्त निर्मित क्षेत्र (बी.ए.आर) पर नियमानुसार बेटरमेंट लेवी देय होगी।

(ii) पूर्वनिर्धारित उपयोग से मिन्न उपयोग निर्धारण हेतु नियमानुसार शुल्क देय होगा।

(iii) भवन निर्माण अनुज्ञा शुल्क एवं अन्य शुल्क देय होंगे।

(iv) अन्य नियमानुसार वसूलनीय शुल्क देय होगा।
