4.12 सैटबेक (Set back):-

(i) सैटबैक का निर्धारण भूखण्ड की सीमा से होगा।

(i) The setback shall be measured from the boundary of the plot.

(ii) एस-6 क्षेत्र अर्थात् नवीन प्रस्तावित योजनाओं / एकल भूखण्डों में जिन भूखण्डों में एक से अधिक सड़क लगती हो, ऐसे भूखण्डों पर सामान्य तौर पर मुख्य सड़क अर्थात् भूखण्ड के सामने स्थित सबसे चौड़ी सड़क की ओर के सैटबेक को अग्र सैटबेक माना जावेगा। अन्य सड़कों की ओर के सैटबैक को पार्श्व सैटबैक माना जावेगा, जिसका निधारण तालिका-05 के अनुसार होगा एवं योजना में उस भूखण्ड की लाइन में निर्धारित सैटबेक से कम नहीं होगा। भूखण्ड पर एक से अधिक मुख्य सड़क (समान चौडाई) स्थित होने पर उन सभी सड़कों की ओर अग्र सैटबैक ही माना जायेगा। जिस ओर सड़क स्थित ना हो, उस ओर के पार्श्व एवं पृष्ठ सैटबेक तालिका-1 के अनुसार निर्धारित किये जायेंगे।

(ii) In S-6 areas, i.e., newly proposed schemes or individual plots having more than one abutting road, the front setback shall generally be considered along the main road, i.e., the widest road facing the plot.
Setbacks along other roads shall be treated as side setbacks, which shall be determined as per Table–05, and shall not be less than the setbacks prescribed in the approved scheme for that plot.
If a plot abuts two or more main roads of equal width, all such sides shall be treated as front setbacks.
For sides not abutting a road, the side and rear setbacks shall be as per Table–01.

(iii) 18 मी. से कम चौडी सड़कों पर स्थित 90 मी. तक के भूखण्डों पर न्यूनतम अग्र सैटबेक 1.5 मी. देय होगा। 18 मी. व इससे अधिक चौडी सड़को पर स्थित 90 मी. तक के भूखण्डों पर न्यूनतम अग्र सैटबैक 3.0 मी. देय होगा।

(iii) For plots up to 90 m depth:

• On roads less than 18 m wide, a minimum front setback of 1.5 m shall be provided.
• On roads 18 m wide or more, a minimum front setback of 3.0 m shall be provided.

(iv) मूल भूखण्ड पर बहुमंजिला भवनों में पार्श्व एवं पृष्ठ सैटबैक तालिका-01 एवं अग्र सैटबैक तालिका-05 अथवा न्यूनतम 6.0 मी. अथवा भवन ऊँचाई का 1/4 (अधिकतम 16 मी.) जो भी अधिक हो रखा जाना अनिवार्य होगा।

(iv) For multi-storeyed buildings on original plots, side and rear setbacks shall be as per Table–01, and front setbacks as per Table–05 or a minimum of 6.0 m or one-fourth of the building height (maximum 16 m) — whichever is higher.

(v) पूर्नगठित भूखण्डों पर बहुमंजिला भवन प्रस्तावित होने पर विनियम 5.3 के अनुसार न्यूनतम सैटबैक एवं अन्य मापदण्ड रखे जाने होंगे।

(v) In case of reconstituted plots, where multi-storeyed buildings are proposed, minimum setbacks and other parameters shall be as per Regulation 5.3.

(vi) किसी भूखण्ड में बहुमंजिला भवन प्रस्तावित होने पर भिन्न-भिन्न ऊँचाई के बिल्डिंग ब्लॉक प्रस्तावित होने की स्थिति में अग्र, पार्श्व एवं पृष्ठ सैटबेक निकटतम बिल्डिंग ब्लॉक की भूखण्ड की चारदीवारी से न्यूनतम दूरी उस बिल्डिंग ब्लॉक की ऊँचाई का 1/4 (अधिकतम 16 मी.) रखा जाना होगा जो कि भूखण्ड के निर्धारित न्यूनतम सैटबेक से कम नहीं होंगे। भूखण्ड के मध्यवर्ती क्षेत्र में स्थित बिल्डिंग ब्लॉक के चारों ओर उसकी ऊँचाई का 1/4 (अधिकतम 16 मी.) दूरी अन्य निकटतम बिल्डिंग ब्लॉक से रखा जाना अनिवार्य होगा।

(vi) In plots with multi-storeyed buildings having blocks of different heights, the minimum distance between the nearest building block and the plot boundary (for front, side, and rear setbacks) shall be one-fourth of that block’s height (maximum 16 m), which shall not be less than the prescribed minimum setback.
Similarly, the distance between adjacent building blocks within the plot shall be at least one-fourth of the block height (maximum 16 m).

(vii) यदि भूखण्ड का आकार इस प्रकार है जिससे भूखण्ड की बाउण्ड्री से अग्र सैटबैक की लाइन निर्धारित करने में समीपस्थ भूखण्डों के लिए निर्धारित अग्र सैटबैक लाईन से समरूपता नहीं बनती है तो सक्षम अधिकारी द्वारा अनुशंषा किये गये अग्र सैटबेक आसपास के भवनों के अग्र सैटबेक को देखते हुए अलग से निर्धारित किया जा सकेगा।

(vii) If the shape of a plot is such that the front setback line cannot align with adjacent plots, the competent authority may fix a special front setback keeping in view the setbacks of adjoining buildings.

(viii) पूर्व में आवंटित / पट्टे शुदा भूमि में से अग्र सैटबेक भूमि समर्पण के पश्चात् समर्पित भूमि की चौडाई के बराबर कम माना जायेगा ताकि भवन रेखा पूर्वानुसार अर्थात् यथावत रहे।

(viii) In previously allotted/leased lands, if part of the front setback has been surrendered to the authority, the setback requirement shall be reduced by the width of the surrendered land, so that the building line remains unchanged.

(ix) अग्र, पार्श्व व पृष्ठ सेटबेक में यदि कोई आर्किटेक्चरल एलीमेंट, जिसका उपयोग केवल भवन की सुंदरता बढाने के लिए किया गया हो, बनाया जा सकता है। इस प्रकार के एलीमेंट को किसी भी उपयोग में नहीं लिया जा सकेगा एवं ऐसा एलीमेंट सेटबेक दूरी का 50 प्रतिशत अथवा 6.0 मी. से अधिक नहीं होगा। परन्तु अग्निशमन वाहन के आवागमन के लिए 6.0 मीटर के गलियारे के ऊपर किसी भी प्रकार का आर्किटेक्चरल एलीमेंट अनुज्ञेय नहीं होगा।

(ix) In front, side, and rear setbacks, architectural elements (used purely for aesthetic enhancement) may be permitted, provided that:

• They are not used for any functional purpose,
• They do not exceed 50% of the setback width or 6.0 m, whichever is less, and
• No such element shall be allowed above the 6.0 m-wide fire access corridor.

(x) तालिका-06 में उल्लेखित संरचनायें (एट्रियम को छोड़कर) सैटबेक में अनुज्ञेय होगी। बशर्ते अग्निशमन वाहन के आवागन हेतु न्यूनतम 6.0 मीटर स्पष्ट रास्ता (जहा लागू होता है) भूतल पर उपलब्ध हो।

(x) The structures listed in Table–06 (except atriums) shall be permissible within setbacks, provided that a clear passage of at least 6.0 m for fire tender movement (where applicable) is maintained at the ground level.

(xi) बैसमेंट/पार्किंग फ्लोर में वाहनों के आवागमन हेतु रेम्प प्रस्तावित होने पर रेम्प का प्रवेश / निकास सड़क सीमा से 6 मी. छोडकर ही देय होगा।

(xi) If ramps are proposed for vehicle movement to the basement or parking floors, their entry/exit points shall be at least 6 m away from the road boundary.

(xii) उप विभाजित भूखण्डों में मूल भूखण्ड के सैटबैक यथावत रहेंगे एवं मध्यवर्ती सैटबैक तालिका-1 के अनुसार रखे जावेगे। उप विभाजित भूखण्डों में ऊँचाई, बी.ए.आर, आच्छादित क्षेत्र मूल भूखण्डों में अनुज्ञेय प्रावधानों के अनुसार अथवा इन विनियम के प्रावधानानुसार, जो भी कम हो देय होंगे।

(xii) In sub-divided plots, the original setbacks of the parent plot shall remain, and intermediate setbacks shall be provided as per Table–01.
Building height, FAR, and coverage for sub-divided plots shall be as per the original plot or these regulations, whichever is more restrictive.

(xiii) दो या दो से अधिक भूखण्डों का पुर्नगठन प्रस्तावित होने पर पुर्नगठित भूखण्ड में सैटबैक व अन्य मापदण्ड पुनर्गठित भूखण्ड के क्षेत्रफल के आधार पर इन विनियमों के अनुसार होंगे।

(xiii) In case of amalgamation (reconstitution) of two or more plots, the setbacks and other parameters shall be determined based on the total area of the reconstituted plot, as per these regulations.

(xiv) गैर योजना क्षेत्र होने अथवा मूल भूखण्ड में सैटबैक / अन्य भवन मानदण्ड निर्धारित नहीं होने की स्थिति में सैटबैक एवं अन्य भवन मानदण्ड इन विनियम के अनुसार अथवा सक्षम अधिकारी द्वारा निर्धारित किये जा सकेंगे।

(xiv) In non-scheme areas or where no setbacks/building parameters have been prescribed for the parent plot, the setbacks and other parameters shall be as per these regulations or as determined by the competent authority.

(xv) मास्टर प्लान / जोनल डवलपमेन्ट प्लान अनुसार प्रमुख सड़कों के दोनों ओर प्रस्तावित ग्रीन बफर (प्लान्टेशन कॉरिडोर) को भूखण्ड का अग्र सैटबैक माना जावेगा जिसमें निम्न गतिविधियां अनुज्ञेय की जा सकेगी :-
राष्ट्रीय राजमार्ग / राज्य राजमार्ग / बाईपास आदि प्रमुख सडकों के दोनों ओर प्रस्तावित 30 मीटर चौडे ग्रीन बफर का अधिकतम 30 प्रतिशत भाग अप्रोच रोड, सर्विस रोड, पार्किंग, ट्रांसफार्मर, गार्ड रूम, भवन का प्रोजेक्शन, पोर्च हेतु अनुज्ञेय किया जा सकेगा लेकिन इसमें कोई अन्डर ग्राउण्ड संरचना या अन्य पक्का निर्माण अनुज्ञेय नहीं होगा।
राष्ट्रीय राजमार्ग / राज्य राजमार्ग / बाईपास आदि प्रमुख सडकों के दोनों ओर प्रस्तावित 30 मीटर बफर जोन में हाईवे पर वाहनों की सुविधा हेतु उपयोग / गतिविधि यथा- पेट्रोल पम्प (अधिकतम 35 मी. x 30 मी.), वे ब्रिज, ऑटोमोबाईल वर्कशॉप आदि अनुज्ञेय किये जा सकेंगे तथापि ऐसे भूखण्डों पर निर्माण सड़क के मार्गाधिकार के पश्चात न्यूनतम 10 मीटर भूमि बफर हेतु छोडने के पश्चात ही किये जा सकेंगे एवं इस 10 मी. बफर में न्यूनतम 6.0 मी. भूमि पर सघन वृक्षारोपण किया जाना अनिवार्य होगा।

(xv) As per the Master Plan / Zonal Development Plan, the green buffer (plantation corridor) proposed along major roads shall be treated as the front setback of the plot, within which the following activities may be permitted:

• In 30 m-wide green buffers along National Highways, State Highways, or Bypasses, up to 30% of the buffer area may be used for approach roads, service roads, parking, transformers, guard rooms, building projections, or porches.
  However, no underground structure or permanent construction shall be allowed in this buffer.
• In the 30 m buffer zone along National/State Highways or Bypasses, facilities for highway users such as petrol pumps (max. 35 m × 30 m), weigh bridges, or automobile workshops may be permitted,
  provided that construction is done after leaving a minimum 10 m buffer beyond the Right of Way (ROW) of the road, and within this 10 m buffer, at least 6.0 m width shall be maintained for dense tree plantation.
