English translation with original Hindi content of Regulation No. 5.4 part-2 and 5.5 of the Jaipur building bye laws 2020

Subdivision/Layout Plan for a Single Plot of Land – In the case landuse in accordance with previously approved land use and maintaining buildings parameter.

(i) Sub-division Fees as per rules will be applicable.

(ii) Previously approved builtup area for the original plot will be considered as the total standard builtup area for the sub-divided plots. This total standard constructed area will be proportionally applicable to each sub-divided plot based on its area.

(iii) Other applicable taxes/fees will be applicable as per rules.

Subdivision/Layout Plan for a Single Plot of Land– In the case of landuse is different previously approved land use and maintaining buildings parameter in accordance with current building regulations

(i) Subdivision fee will be applicable as per rules.

(ii) Construction on subdivided plots will be allowed as per building regulations, and all standards will be applicable as per current regulations.

(iii) The total standard builtup area for the original plot of land will be considered as the standard builtup area for the subdivided plots. This total standard constructed area will be proportionately distributed to each subdivided plot based on its area, and any excess constructed area proposed beyond the standard constructed area for the subdivided plot will be subject to betterment levy as per rules. For example, if 10 plots are proposed after subdivision and if the area proposed for construction in those plots is in proportion to their area, i.e., 20% coverage and 0.60 FAR in 10 plots, no betterment levy will be applicable. However, for residential land use, each plot will be subject to 40% deduction and 2.0 FAR.

(iv) If proposed, additional construction in the residential land will be subject to levying of betterment levy as per regulations.

(v) Other payable fees will also be required as per regulations, including land use determination fee, building construction permission fee,

(vi) and any other applicable fees.

(vii) The construction/modification that has been done on the building map, which is in accordance with these regulations, but not in accordance with the prevailing building regulations at the time of the previous approval, can be approved according to these regulations by paying the necessary modification fee according to these regulations, and a completion/occupation certificate can be issued accordingly.

5.5 In the area of Sector-5, i.e., excluding S-1, S-2, S-3, and S-4, approval can be granted by keeping provisions under these regulations as per the prescribed standards for all remaining urban areas and new proposed plans. Different standards from the provisions of these regulations can be proposed with the approval of the state government while approving a particular plan.

एकल भूखण्ड का उप-विभाजन/ ले-आउट प्लान- पूर्व में अनुमोदित उपयोग के अनुरूप अनुज्ञेय किये गये भवन मानदण्ड यथावत रखने की स्थिति में

(i) नियमानुसार उप-विभाजन शुल्क देय होगा।

(ii) पूर्व में मूल भूखण्ड हेतु स्वीकृति योग्य निर्मित क्षेत्र को उप-विभाजित भूखण्डों हेतु कुल मानक निर्मित क्षेत्र माना जावेगा। यह कुल मानक निर्मित क्षेत्र प्रत्येक उप-विभाजित भूखण्डों में उनके क्षेत्रफल के अनुसार आनुपातिक रूप में देय होगा।

(iii) अन्य नियमानुसार वसूलनीय शुल्क देय होगा।

एकल भूखण्ड का उप-विभाजन/ ले-आउट प्लान– पूर्व में अनुज्ञेयअनुमोदित उपयोग से भिन्न उपयोग एवं वर्तमान भवन विनियमों के अनुसार भवन मानदण्ड रखने की स्थिति में

(i) नियमानुसार उप-विभाजन शुल्क देय होगा।

(ii) उप-विभाजित भूखण्ड पर भवन विनियमों के तहत निर्माण अनुज्ञेय होगा एवं समस्त मानदण्ड वर्तमान विनियमों के अनुसार देय होंगे।

(iii) पूर्व में मूल भूखण्ड हेतु स्वीकृति योग्य निर्मित क्षेत्र को उप- विभाजित भूखण्डों हेतु कुल मानक निर्मित क्षेत्र माना जावेगा। यह कुल मानक निर्मित क्षेत्र प्रत्येक उप-विभाजित भूखण्डों में उनके क्षेत्रफल के अनुसार आनुपातिक रूप में देय माना जाकर उप-विभाजित भूखण्ड में मानक निर्मित क्षेत्र से अधिक निर्मित क्षेत्रफल प्रस्तावित किये जाने पर नियमानुसार बेटरमेन्ट लेवी देय होगी। उदाहरणार्थ:- उप विभाजन किये जाने पर यदि 10 भूखण्ड प्रस्तावित किये जाते है तो 20 प्रतिशत आच्छादन एवं 0.60 बी.ए.आर को 10 भूखण्डों में अनुपातिक रूप से निर्माण प्रस्तावित किये जाने पर कोई बेटरमेट लेवी देय नहीं होगी किन्तु आवासीय भू-उपयोग हेतु प्रत्येक भूखण्ड पर 40 प्रतिशत आच्छादन एवं 2.0 बी.ए.आर प्रस्तावित किये जाने पर अतिरिक्त निर्मित क्षेत्र पर नियमानुसार बेटरमेंट लेवी देय होगी। अन्य नियमानुसार वसूलनीय शुल्क देय होगा ।

(iv) भू-उपयोग निर्धारण शुल्क देय होगा।

(v) भवन निर्माण अनुज्ञा शुल्क एवं अन्य समस्त नियमानुसार देय

(vi) अन्य नियमानुसार वसूलनीय शुल्क जमा कराने होंगे।

(vii) पूर्व स्वीकृति के समय प्रचलित भवन विनियम के अनुरूप स्वीकृत भवन मानचित्र में किया गया ऐसा निर्माण/संशोधन जो कि इन विनियमों में स्वीकृत योग्य है, को इन विनियमों के अनुरूप नियमानुसार देय संशोधन शुल्क लिया जाकर संशोधित भवन मानचित्र स्वीकृत किया जा सकेगा एवं तदानुसार पूर्णता / अधिवास प्रमाण-पत्र जारी किया जा सकेगा।

5.5 एस-5 क्षेत्र अर्थात् एस-1, एस-2, एस-3 व एस-4 को छोड़कर शेष समस्त नगरीय क्षेत्र व नई प्रस्तावित योजनाओं में इन विनियमों के तहत निर्धारित मानदण्डों के अनुसार प्रावधान रखते हुए स्वीकृति दी जा सकेगी। किसी विशिष्ट योजना हेतु योजना अनुमोदित करते समय इन विनियमों के प्रावधानों से भिन्न मानदण्ड राज्य सरकार की स्वीकृति से प्रस्तावित किये जा सकेंगे।
