6 Building Approval Process:

6. भवन निर्माण स्वीकृति की प्रक्रियाः

Except for independent houses, farmhouses, and eco-friendly housing plots, it is mandatory to obtain a Completion Certificate and an Occupancy Certificate for multi-residential units/flats/group housing and plots with an area of 500 square meters or more for all types of use upon the completion of building construction. The Completion Certificate can be issued once the construction is fully completed according to the approved building plans.

The issuance of the Completion Certificate will be ensured only after verifying that the civil work (masonry and RCC work), plastering, windows and doors/structural glazing work, sanitary and electrical fittings, railings, lifts, flooring, and community facilities are completed as per the approved plans.

It is also mandatory to obtain the Completion Certificate and Occupancy Certificate for buildings as mentioned in the provisions of the Real Estate (Regulation and Development) Act, 2016, and the Rajasthan Real Estate (Regulation and Development) Rules, 2017 framed under it. (Dated: 10.08.2023)

6.1 स्वतंत्र आवास / फार्म हाउस / पर्यावरण मैत्री आवास के भूखण्डों को छोडकर बहु निवास इकाई / फ्लेट्स / ग्रुप हाउसिंग एवं 500 वर्गमीटर व उससे अधिक क्षेत्रफल के समस्त उपयोग के भूखण्डों पर भवन का निर्माण पूरा होने भवन निर्माणकर्ता को पूर्णता प्रमाण-पत्र एवं अधिवास प्रमाण पत्र प्राप्त करना आवश्यक होगा। भवन का निर्माण स्वीकृत भवन मानचित्रों अनुसार पूर्ण हो जाने पर पूर्णता प्रमाण-पत्र किया जा सकेगा। भवन में सिविल वर्क (मेशनरी व आरसीसी वक), प्लास्टर, खिडकी व दरवाजे / स्ट्रक्चरल ग्लेजिंग वर्क, सेनटरी व बिजली पानी फिटिंग, रेलिंग, लिफ्ट, फ्लोरिंग, व सामुदायिक सुविधाओं का निर्माण आदि अनुमोदित मानचित्र अनुसार पूर्ण होने की सुनिश्चितता पश्चात ही पूर्णता प्रमाण पत्र जारी किया जायें। रियल एस्टेट (रेगुलेशन एण्ड डवलपमेंट) अधिनियम, 2016 एवं इसके तहत बनाये गये राजस्थान रियल एस्टेट (रेगुलेशन एण्ड डवलपमेंट) नियम, 2017 के प्रावधानों में उल्लेखित भवनों हेतु पूर्णता प्रमाण-पत्र एवं अधिवास प्रमाण पत्र प्राप्त करना आवश्यक होगा। (10.08.2023)

Any building in the urban area can only be constructed according to the prior written approval of the competent authority, and the building can only be constructed according to the approved building map/maps on the land approved by the competent authority.

नगरीय क्षेत्र में कोई भी भवन निर्माण सक्षम अधिकारी की पूर्व लिखित स्वीकृति अनुसार ही किया जा सकेगा एवं भूखण्ड पर निर्माण सक्षम अधिकारी द्वारा अनुमोदित भवन मानचित्र/मानचित्रों के अनुसार ही भवन निर्माण कार्य किया जा सकेगा।

However,

परन्तुः-

(i) Except for the S-2 walled city area defined under Regulation-3.0 and special areas and roads defined under Regulations-10.4 and 10.5, in other urban areas, construction on plots up to 500 square meters for all uses, or on such plots where a maximum built-up area of 500 square meters is proposed, can be undertaken after submitting the following documents certified by a registered architect/technician in the prescribed format and after depositing all due fees with the concerned authority:

(i) विनियम-3.0 के अनुसार निर्धारित एस-2 चार दीवारी क्षेत्र एवं विनियम-10.4 व 10.5 के तहत निर्धारित विशेष क्षेत्रों एवं विशेष सड़कों को छोड़कर शेष नगरीय क्षत्रों में 500 व.मी. क्षेत्रफल तक के सभी उपयोगों के भूखण्डों अथवा ऐसे भूखण्ड जिनमें अधिकतम 500 व. मी. निर्मित क्षेत्र प्रस्तावित हो में भवनों का निर्माण पंजीकृत वास्तुविद/तकनीकीविद द्वारा प्रमाणित निम्न दस्तावेज निर्धारित प्रारूप में प्रस्तुत करने एवं समस्त देय राशि संबंधित निकाय में जमा करने के पश्चात किया जा सकेगा –

a. Latitude/Longitude of the plot / Plot location on Google Map.

अ- भूखण्ड के Latitude/Longitude / भूखण्ड की Google Map पर लोकेशन ।

b. Lease deed and site plan. (For cases involving the local body’s plan and lease deed/patta issued by the urban body, for building construction approval cases, the certification of lease deed/ownership-related documents by an advocate registered with the Bar Council of India will be accepted.)

ब- लीजडीड व साइट प्लान । (स्थानीय निकाय की योजना एवं नगरीय निकाय द्वारा जारी लीजडीड / पट्टा प्रकरणों के अतिरिक्त भवन निर्माण स्वीकृति के प्रकरणों में लीजडीड / स्वामित्व संबंधित दस्तावेजों का बार कांउसिल ऑफ इण्डिया द्वारा पंजीकृत अधिवक्ता द्वारा प्रमाणिकरण मान्य होगा)

c. Site plan including proposed setbacks and the proposed height and number of floors of the building.

स- साईट प्लान मय प्रस्तावित सैटबेक व भवन की प्रस्तावित ऊँचाई व मंजिलों की संख्या ।

d. For commercial plots, a parking plan certified by a technician, showing the provision for parking.

द- व्यवसायिक भूखण्डों में पार्किंग हेतु प्रावधान दर्शाते हुए तकनीकीविद द्वारा प्रमाणित पार्किंग प्लान।

e. A declaration by the registered technician stating compliance with building regulations (Format-B).

य- पंजीकृत तकनीकीविद का भवन विनियमों अनुसार प्रावधानों की अनुपालना किये जाने का घोषणा पत्र (प्रारूप-ब)

(i) Except for the designated S-2 four-walled area under regulation 3.0 and the designated special areas and roads under regulations 10.4 and 10.5, all uses of land up to an area of 500 sqm in all remaining urban areas, or areas where a maximum of 500 sqm built-up area is proposed, can be constructed according to the approved building map on the land.

(i) विनियम-3.0 के अनुसार निर्धारित एस-2 चार दीवारी क्षेत्र एवं विनियम – 10.4 व 10.5 के तहत निर्धारित विशेष क्षेत्रों एवं विशेष सड़कों को छोड़कर शेष नगरीय क्षेत्रों में 500 व.मी. क्षेत्रफल तक के सभी उपयोगों के भूखण्डों अथवा ऐसे भूखण्ड जिनमें अधिकतम 500 व.मी. निर्मित क्षेत्र प्रस्तावित हो में भवनों का निर्माण पंजीकृत वास्तुविद/तकनीकीविद द्वारा प्रमाणित निम्न दस्तावेज निर्धारित प्रारूप में प्रस्तुत करने एवं समस्त देय राशि संबंधित निकाय में जमा करने के पश्चात किया जा सकेगा–

A- Latitude / Longitude of the plot / Location of the plot on Google Map.

अ- भूखण्ड के Latitude/Longitude/ भूखण्ड की Google Mapपर लोकेशन।

B- Lease deed and site plan (verified by a registered attorney with the Council of India related to leasehold/ownership documents).

ब- लीजडीड व साइट प्लान (लीजडीड/स्वामित्व संबंधित दस्तावेजों का बार काउंसिल ऑफ इण्डिया द्वारा पंजीकृत अधिवक्ता द्वारा प्रमाणिकरण मान्य होगा)

C- Proposed site plan showing proposed setbacks and building height and number of floors.

स- साईट प्लान मय प्रस्तावित सैटबेक व भवन की प्रस्तावित ऊँचाई व मंजिलों की संख्या ।

D Provision for parking in commercial plots.

द. व्यवसायिक भूखण्डों में पार्किंग हेतु प्रावधान।

E- Certificate from a registered technical expert that the building is constructed according to regulations.

य- पंजीकृत तकनीकीविद का भवन विनियमों अनुसार प्रावधानों की अनुपालना किये जाने का प्रमाण-
पत्र।

r. Applicant’s affidavit (Format-A)

र- आवेदक का शपथ पत्र (प्रारूप-अ)

l. Receipt of the fee related to building plan approval deposited online/offline in the urban body’s bank account.

ल- भवन मानचित्र अनुमोदन से संबंधित देय राशि नगरीय निकाय के बैंक खाते में ऑनलाईन / ऑफलाईन जमा होने की रसीद ।

v. Receipt of lease and urban development tax payment.

व- लीज एवं नगरीय विकास कर की जमा की रसीद ।

s. Demand letter from the registered technician/applicant regarding the fee payable as per building regulations (Format-D).

स- पंजीकृत तकनीकीविद / आवेदक का भवन विनियम अनुसार देय शुल्क के संबंध में मांग पत्र (प्रारूप-द)

Therefore, as per the above, ensure that the demand note letter in the prescribed format by the technician is sent to the applicant and a copy to the concerned urban body. Upon submission of certified documents by the registered architect in the prescribed format, ensure that an acknowledgment in the prescribed Format-Y is issued by the local body.

अतः उपरोक्त के अनुसार तकनीकीविद् द्वारा निर्धारित प्रारूप में डिमाण्ड नोट पत्र आवेदक को तथा एक प्रतिलिपि संबंधित नगरीय निकाय को प्रेषित किये जाने पर आवेदक को चालान जारी कराया जाना सुनिश्चित करावे एवं पंजीकृत वास्तुविद्ध प्रमाणित दस्तावेज निर्धारित प्रारूप में प्रस्तुत करने पर स्थानीय निकाय द्वारा प्राप्ति स्वीकार की सूचना (Acknowledgement) निर्धारित प्रारूप-य में दिया जाना सुनिश्चित करें।

As per the Urban Development Department’s order dated 14.06.2021, it is mentioned that when issuing a patta (lease deed) for up to 500 square meters, construction approval should be issued. In this regard, it is clarified that along with the patta, approval for the ground floor and first floor should be issued, and if additional floors are desired after approval for the ground + first floor, the previously deposited amount should be adjusted, and the fee for the additional permissible construction should be paid as per regulations.

नगरीय विकास विभाग के आदेश दिनांक 14.06.2021 के अनुसार 500 वर्गमीटर तक का पट्टा जारी करते समय निर्माण स्वीकृति जारी किये जाने का उल्लेख है। इस सम्बन्ध में यह स्पष्ट किया जाता है कि पट्टे के साथ भूतल प्रथमतल की स्वीकृति जारी की जायें एवं भूतल + प्रथमतल की स्वीकृति के पश्चात् भवन विनियम के अनुसार देय अधिक मंजिलों की भवन निर्माण स्वीकृति चाहने पर पूर्व में इस मद में जमा राशि का समायोजन करते हुये अतिरिक्त अनुज्ञेय निर्माण हेतु नियमानुसार राशि देय होगी ।

(ii) For all plots with an area between 500 square meters and 2500 square meters, for all land uses, under Regulations 19 and 20, after approval of the registered architectural and building plans, and upon submission of the payable fee, necessary documents, and certified maps of the proposed building in the prescribed format to the concerned urban body, the building construction can be deemed approved.

(ii) 500 व.मी. से अधिक एवं 2500 व.मी. क्षेत्रफल तक के समस्त भू उपयोग के भूखण्डों पर विनियम सं. 19 व 20 के तहत पंजीकृत वास्तु तथा भवन मानचित्र अनुमोदन पश्चात् देय राशि व आवश्यक दस्तावेज एवं प्रस्तावित भवन के प्रमाणित मानचित्र आदि निर्धारित प्रारूप में संबंधित नगरीय निकाय में जमा कराने के पश्चात् भवन निर्माण प्रारम्भ करने हेतु डीम्ड अनुमोदित माना जा सकेगा।

a. Latitude/longitude of the plot / Plot location on Google Map.

b. Lease deed and site plan (Certification of lease deed/ownership-related documents by an advocate registered with the Bar Council of India will be accepted).

ब- लीजडीड व साइट प्लान (लीजडीड / स्वामित्व संबंधित दस्तावेजों का बार कांउसिल ऑफ इण्डिया द्वारा पंजीकृत अधिवक्ता द्वारा प्रमाणिकरण मान्य होगा)।

c. Site plan showing proposed setbacks, proposed building height, and number of floors.

स- साईट प्लान प्रस्तावित सैटबैक व भवन की प्रस्तावित ऊंचाई व मंजिलों की संख्या ।

d. Provision for parking in plots for all land uses.

द- समस्त भू उपयोग के भूखण्डों में पार्किंग हेतु प्रावधान।

y. Signed set of building maps showing floor plans of all proposed floors, sections, elevations, parking, circulation plan, fire/green area, etc.

य- प्रस्तावित भवन के सभी मंजिलों के फ्लोर प्लान, सैक्शन, एलीवेशन, पार्किंग व सर्कुलेशन प्लान, फायर/ग्रीन एरिया आदि दर्शाते हुये भवन मानचित्रों का हस्ताक्षरित मानचित्रों का सैट।

r. Certificate of compliance with building regulations provisions from a registered technician.

र- पंजीकृत तकनीकीविद् का भवन विनियमों अनुसार प्रावधानों की अनुपालना किये जाने का प्रमाण पत्र ।

l. Receipt of lease and urban development tax payment.

ल- लीज एवं नगरीय विकास कर की जमा की रसीद ।

v. Receipt of fee related to building plan approval deposited online/offline in the urban body’s bank account. Therefore, in this sequence, ensure that the demand note letter in the prescribed format provided at the time of registration by the Chief Town Planner of Rajasthan (refer to the attached Formats 1-18) is sent to the applicant and a copy to the concerned urban body. Upon submission of certified documents in the prescribed format by the registered architects according to the building regulations, ensure that an acknowledgment in the prescribed Format-Y is issued by the local body.

व – भवन मानचित्र अनुमोदन से संबंधित देय राशि नगरीय निकाय के बैंक खाते में ऑनलाईन / ऑफलाईन जमा होने की रसीद । अतः उपरोक्त के क्रम में मुख्य नगर नियोजक राजस्थान द्वारा तकनीकीविदों के पंजीकरण के समय उपलब्ध करवाये गये निर्धारित प्रारूप (प्रति संलग्न प्रारूप 1-18) में डिमाण्ड नोट पत्र आवेदक को तथा एक प्रतिलिपि संबंधित नगरीय निकाय को प्रेषित किये जाने पर आवेदक को चालान जारी कराया जाना सुनिश्चित कराये एवं पंजीकृत वास्तुविदों द्वार भवन विनियमों के प्रावधानों अनुसार दी जाने वाली भवन मानचित्र स्वीकृति मय प्रमाणित दस्तावेज निर्धारित प्रारूप में प्रस्तुत करने पर स्थानीय निकाय द्वारा प्राप्ति स्वीकार की सूचना (Acknowledgement) निर्धारित प्रारूप-य में दिया जाना सुनिश्चित करें।

F- Receipt of payment deposited online/offline in the bank account of the municipal corporation for the amount due in relation to the building plan approval.

र- भवन मानचित्र अनुमोदन से संबंधित देय राशि नगरीय निकाय के बैंक खाता में ऑनलाईन / ऑफलाईन जमा होने की रसीद

(ii)- After the approval of the building plan, for all plots with an area of more than 500 sqm and up to 2500 sqm of all land use, the construction can be deemed approved by depositing the due amount, necessary documents, and proposed certified building map in the prescribed format in the municipal corporation.

(ii) 500 व.मी. से अधिक एवं 2500 व.मी. क्षेत्रफल तक के समस्त भू-उपयोग के भूखण्डों पर विनियम संख्या 19 व 20 के तहत पंजीकृत वास्तुविद द्वारा भवन मानचित्र अनुमोदन पश्चात देय राशि व निम्न आवश्यक दस्तावेज एवं प्रस्तावित भवन के प्रमाणित मानचित्र आदि निर्धारित प्रारूप में संबंधित नगरीय निकाय में जमा कराने के पश्चात भवन निर्माण प्रारंभ करने हेतु डीम्ड अनुमोदित (Deemed Approved) माना जा सकेगा।

A- Lease deed/site plan (verified by a registered attorney with the Bar Council of India related to leasehold/ownership documents).

अ. लीज डीडवसाइटप्लान (लीजडीड/स्वामित्व संबंधित दस्तावेजो का बारकाउंसिल ऑफ इण्डिया द्वारा पंजीकृत अधिवक्ता द्वारा प्रमाणिकरण मान्य होगा) |

B- Proposed setback.

ब. प्रस्तावित सैटब्रेक ।

C- Building height and number of floors.

स भवन की ऊँचाई व मंजिलों की संख्या।

D- Provision for parking in all land use.

द. समस्त भू-उपयोग के भूखण्डों में पार्किंग हेतु प्रावधान।

E- Signed map set of Floor plan, section elevation, parking, and circulation plan, plan showing fire/ green area for all floors of the proposed building.

य प्रस्तावित भवन के सभी मंजिलों के फ्लोर प्लान, सेक्शन एलीवेशन, पार्किंग व सर्कुलेशन प्लान फायर/शीन एरिया आदि दर्शाते हुए भवन सानचित्रों का हस्ताक्षरित मानचित्रों का सैदा

F- Certificate from registered architect mentioning compliance with the provisions according to the building regulations.

र पंजीकृत वास्तुविद का भवन विनियम अनुसार प्रावधानों की अनुपालना किये जाने का प्रमाण-

G-The amount due for building map approval should be deposited in the municipal bank account online/offline and a receipt obtained.

ल भवन मानचित्र अनुमोदन से संबंधित देय राशि नगरीय निकाय के बैंक खाता में ऑनलाइन ऑफलाईन जमा होने की रसीद।

Note:

नोट:-

Above deemed approval is applied only for cities with a population of more than 1lakh, and height of up to 18 meters and up to 15 meters for other cities except those mentioned above. If the proposed height exceeds the above, it will be mandatory to obtain building map approval from the local authority as per the regulations.

उक्त अनुमोदन 100 लाख से अधिक जनसंख्या वाले शहर हेतु 18 मी. की ऊँचाई तथा उपरोक्त शहरों को छोड़कर शेष शहरों हेतु 15 मी. की ऊँचाई तक ही अनुज्ञेय किया जा सकेगा। उपरोक्त से अधिक ऊँचाई प्रस्तावित होने पर नियमानुसार स्थानीय निकाय से भवन मानचित्र स्वीकृति प्राप्त किया जाना अनिवार्य होगा।

To get benefit of clause 6(i) & 6(ii) one should obtain approval from Registered architects/technical experts ; otherwise, the construction done on the plot is considered in the category of construction without approval and concerned urban authority will take action as per rules

विनियम संख्या-6(i) एवं 6(ii) तहत प्रक्रिया का लाभ प्राप्त करने हेतु पंजीकृत वास्तुविद तकनीकीविद से भवन मानचित्र अनुमोदन आवश्यक होगा अन्यथा भूखण्ड पर किया गया निर्माण बिना स्वीकृति निर्माण की श्रेणी में माना जाकर संबंधित नगरीय निकाय द्वारा नियमानुसार कार्यवाही की जा सकेगी।

Under regulation number – 6 (i) and 6 (ii), the construction on the plot will have to be done according to the building regulations, otherwise, if the norms of the building regulations are violated, the entire responsibility will be of the plot holder and the construction by the local body contrary to such building regulations Can be seized or demolished as per rules.

विनियम संख्या – 6 (i) एवं 6 (ii) के तहत भूखण्ड पर निर्माण भवन विनियमों के अनुसार ही किया जाना होगा, अन्यथा भवन विनियमों के मानदण्डों का उल्लंघन होने पर संपूर्ण जिम्मेदारी भूखण्डधारी की होगी एवं स्थानीय निकाय द्वारा ऐसे भवन विनियमों के विपरीत निर्माण को नियमानुसार सीज अथवा ध्वस्त किया जा सकेगा।

After deemed approval under Regulation 6(i) in case of the building map has been approved by the registered architect as per Regulation-16(i) and 17, it will be mandatory to obtain completion certificate and occupation certificate as per rules through the same architect or from the competent officer of the local body.

विनियम 6 (ii) के तहत डीम्ड अप्रूवल पश्चात विनियम-16(i) एवं 17 के अनुसार जिस पंजीकृत वास्तुविद द्वारा भवन मानचित्र अनुमोदन किया गया है उसी वास्तुविद के माध्यम से अथवा स्थानीय निकाय के सक्षम अधिकारी से नियमानुसार पूर्णता प्रमाण-पत्र एवं अधिवास प्रमाण- पत्र भी लिया जाना अनिवार्य होगा।

(iii) Approval will not be required for the following types of construction work if these works/changes
shall not violate other provisions of the building regulations:-

(iii) निम्न प्रकार के निर्माण कार्य हेतु स्वीकृति की आवश्यकता नहीं होगी यदि इन कार्यो/परिवर्तनों से भवन विनियमों के अन्य प्रावधानों का उल्लंघन नहीं हो:-

(a) Internal changes during construction after obtaining the building map (such internal changes such as changes in the layout plan of the building/s, in the location of blocks in the building premises) Changes, changes in the layout of parking and such changes which do not lead to change gross built up area of the building, setback, covered area, external dimensions of the building and does not contravene any provision of building regulations.

(क) भवन मानचित्र प्राप्त किये जाने के पश्चात निर्माण के दौरान आंतरिक परिवर्तन (ऐसा आंतरिक परिवर्तन यथा भवन/भवनो के ले-आउट प्लान में परिवर्तन, भवन परिसर में ब्लॉक्स की लोकेशन में परिवर्तन, पार्किंग के ले-आउट में परिवर्तन एवं ऐसे परिवर्तन जिसके कारण भवन के सकल निर्मित क्षेत्र, सेंटबेक, आच्छादित क्षेत्र, भवन के बाहरी परिमाप एवं भवन विनियमों के किसी प्रावधान का उल्लंघन नहीं होता हो)

(b) for gardening.

(ख) बागवानी हेतु।

(c) for whitewashing

(ग) सफेदी कराने हेतु

(d) for dyeing.

(घ) रंगाई हेतु ।

(e) For re-tiles or re-roofing.

(ड) पुन टाइल्स अथवा पुनः छत बनवाने हेतु ।

(f) for plastering.

(घ) प्लास्टर करने हेतु।

(g) For re-flooring.

(छ) पुनः फर्श बनवाने हेतु।

(h) For the construction of Chajja in the land owned by him.

(ज) स्वयं के स्वामित्व की भूमि में छज्जा निर्माण कराने हेतु।

(i) For reconstruction of building destroyed by natural calamity to the extent of original stage of construction before calamity

(झ) प्राकृतिक विपदा के कारण नष्ट हुए भवन को उस सीमा तक जिस सीमा तक नष्ट होने से पूर्व निर्माण था, पुनः निर्माण हेतु।

(j) From the point of view of security, boundary wall up to 2.4 meters height and 1 meter grill / fencing on the boundary .

(ञ) सुरक्षा की दृष्टि से 2.4 मीटर तक ऊंचाई की बाउण्ड्रीवाल तथा बाउण्ड्रीवाल पर 1 मीटर grill फेन्सिंग हेतु।

(k) Tank for storage of water, septic tank, well etc.

(ट) पानी के भण्डारण हेतु टैंक सेफ्टिक टैंक कुई आदि

(l) Cooling Plant Solar Plant

(ठ) कूलिंग प्लान्ट सोलर प्लान्ट

(m) Services and facilities related to the building like air conditioning, fire protection, rain water harvesting, sewage treatment plant, watchman room etc.

(ड) भवन से संबंधित सेवायें एवं सुविधायें जैसे वातानुकूलन, आग से बचाव, वर्षा जल संग्रहण, सीवेज ट्रीटमेंट प्लांट, चौकीदार कक्ष इत्यादि।

(n) Construction of stairs /rump required for fire safety / medical requirement in the building.

(ढ) भवन में अग्निशमन सुरक्षा/चिकित्सीय आवश्यकता हेतु आवश्यक सीढ़ियाँ/रेम्प निर्माण।

(o) Construction of stairs /Lift in the building which is in accordance with the building regulations.

(ण) भवन में सीढी/लिफ्ट का निर्माण जो कि भवन विनियमों के अनुरूप हो।

(p) Temporary construction under special circumstances

(त) विशेष परिस्थिति में अस्थायी निर्माण।
