4.3 General Rules of Residential

4.4 वाणिज्यिक भवन (Commercial Building) :-

1. सामान्य नियम (General Rules) :-

(i) वाणिज्यिक भूखण्ड किसी स्वीकृत योजना का हिस्सा होने पर योजना के प्रावधान / पैरामीटर्स लागू होंगे व सड़क की चौड़ाई योजना अनुसार ही मान्य होगी अर्थात किसी योजना में 12 मीटर से कम चौडी सडक पर यदि दुकाने प्रस्तावित है तो उस पर निर्माण स्वीकृति दी जा सकती है। योजना में यदि किसी भूखण्ड पर भूतल पर शत प्रतिशत निर्माण अनुज्ञेय है तथा योजना में सार्वजनिक पार्किंग का प्रावधान रखा गया है तो वहाँ पृथक से पार्किंग का प्रावधान करना आवश्यक नहीं होगा एवं पार्किंग की पूर्ति हेतु कोई शुल्क भी देय नहीं होगा।

(i) Where a commercial plot forms part of an approved plan, the provisions/parameters of that plan shall apply, and the road width prescribed in the plan shall be considered valid. Accordingly, if shops are proposed on a road less than 12 meters wide as per the plan, building permission may be granted. If, in a plan, 100% construction on the ground floor is permissible on a particular plot and public parking has been provided for in the plan, then separate parking provision shall not be required, and no parking fee shall be payable to meet the parking requirement.

(ii) जिन व्यावसायिक योजनाओं में टाईप डिजाईन निर्धारित है, उनमें टाईप डिजाईन के आधार पर ही निर्माण स्वीकृति दी जावेगी। आंतरिक संरचना टाईप डिजाईन से भिन्न भी हो सकती है। यदि ऐसी पुरानी योजनाओं में वर्तमान परीपेक्ष्य में नवीन निर्माण किया जाना प्रस्तावित हो तो ऐसी योजनाओं का पुर्नविकास प्लान (Re-development Plan) तैयार किया जाकर ही तदानुसार नवीन भवन निर्माण स्वीकृतियां जारी की जानी होगी। एकल रूप में टाईप डिजाईन से भिन्न स्वीकृति नहीं दी जायेगी।

(ii) In commercial schemes where type designs have been specified, building permission shall be granted only on the basis of the approved type design. The internal layout may differ from the type design. If new construction is proposed in such older schemes in the present context, a Re-development Plan must first be prepared, and building permissions for new construction shall be granted accordingly. No individual approval deviating from the type design shall be granted.

(iii) वाणिज्यिक बहुमंजिला भवन 1000 वर्गमीटर से अधिक क्षेत्रफल के भूखण्ड एवं सड़क की चौड़ाई न्यूनतम 24 मीटर होने पर ही देय होंगे।

(iii) Commercial multi-storey buildings shall be permissible only on plots measuring more than 1,000 sq. m. in area and having a minimum road width of 24 meters.

(iv) 2500 वमी से अधिक क्षेत्रफल के वाणिज्यिक भूखण्डों पर तालिका-01 में अंकित आच्छादित क्षेत्र के स्थान पर अधिकतम आच्छादित क्षेत्र 50 प्रतिशत देय होगा।

(iv) For commercial plots of more than 2,500 sq. m. in area, in place of the covered area specified in Table-01, a maximum covered area of 50% shall be permissible.

(v) वाणिज्यिक भूखण्ड पर वाणिज्यिक / पर्यटन इकाई/आवासीय / संस्थागत उपयोग एकल उपयोग अथवा सम्मिलित उपयोग के भवन अनुज्ञेय होगें एवं समस्त शुल्क व मापदण्ड तदानुसार प्रस्तावित उपयोग के अनुसार ही लागू होगें।

(v) On a commercial plot, buildings for commercial/tourism units/residential/institutional use—whether for single use or mixed use—shall be permissible, and all applicable fees and parameters shall be applied according to the proposed use.

2. लघु व्यावसायिक प्रतिष्ठान / दुकानें (Convenient shops/ Establishment) :-

(i) लघु व्यावसायिक प्रतिष्ठान / दुकानें योजना का भाग होने पर भवन के मापदण्ड वाणिज्यिक भवनों के सामान्य नियम (i) एवं (ii) के अनुसार लागू होंगे अन्यथा तालिका-01 के अनुसार रखे जाने अनिर्वाय होंगे। यदि योजना में सार्वजनिक पार्किग का प्रावधान रखा गया हो तो 50 व.मी. क्षेत्रफल तक के भूखण्डों में पृथक से पार्किंग प्रावधान किया जाना आवश्यक नहीं होगा। 50 वर्गमीटर से बडे भूखण्डों में भूखण्ड के अन्दर तालिका-16 के अनुसार पार्किंग प्रावधान रखा जाना अनिवार्य होगा।

(i) If small commercial establishments/shops are part of a planned scheme, then the building standards shall be governed by the general rules for commercial buildings under clauses (i) and (ii). Otherwise, compliance with Table-01 will be mandatory.
If public parking provision has been made within the scheme, then for plots up to 50 sq. m., a separate parking provision shall not be required. For plots larger than 50 sq. m., provision for parking within the plot as per Table-16 shall be mandatory.

(ii) मुख्य सड़क से लगते हुए पंक्तिबद्ध (Row of Buildings/Plots) 500 व.मी. क्षेत्रफल तक वाणिज्यिक क्षेत्रों में अधिकतम 10 मी. (भूतल + 2 मंजिलों) के निर्माण हेतु साइड सैटबैक छोडा जाना अनिवार्य नहीं होगा एवं अग्र सैटबैक में बाउण्ड्री वॉल का निर्माण नहीं किया जावेगा। पार्किंग का प्रावधान तालिका-16 के अनुसार रखा जाना होगा।

(ii) For row buildings/plots adjoining the main road within commercial areas, up to 500 sq. m. plot area and up to a maximum building height of 10 m (Ground Floor + 2 Floors), it shall not be mandatory to leave a side setback, and no boundary wall shall be constructed in the front setback. Parking provisions shall be made as per Table-16.

(iii) 500 व.मी. क्षेत्रफल तक के वाणिज्यिक भूखण्डों में बेसमेंट में व्यावसायिक गतिविधि अनुज्ञेय नहीं होंगी।

(iii) In commercial plots up to 500 sq. m. area, commercial activities in the basement shall not be permissible.
